<br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-11-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO RALPH AND <br />VERNICE JACOBSEN AT 8240 154TH LANE NW (pERMITTEES) FOR ACCESSORY <br />STRUCTURE SIDEWALL HEIGHT RESTRICTIONS AND DECLARING TERMS OF <br />SAME <br /> <br />WHEREAS, Ralph & Vemice Jacobsen (permittees) have properly applied for a <br />variance from Section 9.11.02 of the Ramsey City Code for the sidewall height of an accessory <br />building on the property generally known as 8240 154th LaneNW and legally described as <br />follows: <br /> <br />Lot 6, Block 9, Whispering Pines Estates, Anoka County, Minnesota <br /> <br />(Subject Property). <br /> <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on November 2, <br />2006, pursuant to Section 9.03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE,_BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact # _ a variance to the sidewall height restriction of an <br />a<;cessory building on the Subject Property is hereby granted. <br /> <br />2. That the sidewall height of the accessory building shall not exceed fourteen (14) feet. <br /> <br />3. That no other structure or addition shall be constructed unless it is in accordance with City <br />Code~ ' <br /> <br />4. That the Permittees shall be responsible for all costs incurred in administering and enforcing <br />this variance. <br /> <br />5. That the Permittees shall obtain all necessary permits prior to commencing any construction <br />of the accessory building. <br /> <br />6. That the accessory building shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless it is in accordance <br />with City Code. <br /> <br />7. That the Permittees agree that the terms of this Variance shall be binding upon its successors <br />and assigns. <br /> <br />10 <br />
