7. 2. <br />CC Regular Session <br />Meeting Date: 01/09/2024 <br />Primary Strategic Plan Initiative: Promote economic growth and development. <br />Information <br />Title: <br />Adopt Ordinance #24-01 Rezoning 7790 and 7750 Sunwood Drive to COR-1 and Adopt Resolution #24-019 <br />Approving the Development Agreement and Sidewalk Encroachment Agreement for Storyteller Cafe (Project <br />No. 23-118); Case of Stories Foundation <br />Purpose/Background: <br />On December 12, 2023, the City Council approved (with contingencies) the Final Plat and Site Plan for <br />Storyteller Cafe, located at 7790 Sunwood Drive (the "Subject Property"), proposed by Stories Foundation (the <br />"Applicant"). That same evening, the City Council introduced Ordndance #24-01, which will rezone the Subject <br />Property, along with 7750 Sunwood Drive (Sunwood Village apartments), from COR-2 to COR-1, to <br />accommodate three (3) apartments proposed on the second floor of the building. The purpose of this case is <br />twofold. First, to formally adopt Ordinance #24-01, rezoning the two properties from COR-2 to COR-1, and <br />secondly, to adopt Resolution #24-019 approving the Development Agreement and a Sidewalk Encroachment <br />Agreement for Storyteller Cafe. <br />Notification: <br />A public notice was sent to all property owners within 350 feet of the Subject Property to inform them of the <br />request for Planning Commission review of the Site Plan and Minor Plat. Staff also attempted to notify property <br />owners within 350 feet of the Subject Property, as reflected in the Anoka County Property Records, of the Public Hearing the <br />City Council conducted regarding the proposed Zoning Map Amendment. A notice of the Public Hearing was also published in <br />the Anoka County UnionHerald, the City's official newspaperA "proposed development" sign was placed on the Subject <br />Property. No additional notification was required for the proposed actions this evening. <br />Time Frame/Observations/Alternatives: <br />As noted, the City Council introduced Ordinance #24-01 on December 12, 2023, and the ordinance is now <br />eligible for adoption. Every development requires a Development Agreement, which outlines the conditions of <br />approval, responsibility for improvements, and development fees. Furthermore, due to the required ten (10) foot <br />wide sidewalk along Sunwood Drive, a portion of the public sidewalk will encroach onto the Subject Property. <br />Thus, a Sidewalk Encroachment Agreement is also necessary. This document not only addresses the <br />encroachment but also specifies responsibilities for maintenance of the public sidewalk. Adoption of Resolution <br />#24-019 will approve both of these agreements. <br />Funding Source: <br />All costs related to this request are the responsibility of the Applicant. <br />Recommendation: <br />Staff recommends adopting Ordinance #24-01 and Resolution #24-019 approving the rezoning and both <br />agreements, respectively. <br />Outcome/Action: <br />
