For purposes of this sign code, expansion means: <br />i. An increase to the sign area that increases the level of nonconformity; <br />ii. An increase to the height of the sign that increases the level of noncon- <br />formity; <br />iii. An increase to the dimensions of the sign cabinet or increase in the depth <br />of the sign; or <br />iv. Removal of the sign and installation of the sign at a new location. <br />b. A legally established nonconforming sign may not be expanded except to bring <br />the sign into compliance with this sign code. <br />(3) Creation of nonconformities by public action. <br />a. Where there exists as of the date of adoption of this section a conforming sign <br />and a subsequent taking by a governmental body occurs under eminent domain <br />or negotiated sale which renders such sign in violation of one or more provisions <br />of this chapter, such sign becomes a legal non -conformity and may be used <br />thereafter only in accordance with the provisions of this section. <br />b. The planning commission may consider government taking as a practical diffi- <br />culty used with a request for a variance to a setback regulation for pre-existing <br />signs. <br />(4) Additional standards for nonconformities within the Mississippi River Corridor Critical <br />Area Overlay District are found in section 106-910. <br />24 Article II. Applications and procedures. <br />25 Sec. 108-200 — Purpose. <br />26 The following sections set forth standards and regulations for permit requirements for all types <br />27 of signage. <br />28 Sec. 108-210 — Permitted and prohibited signs. <br />29 All permanent signs shall obtain a permit prior to installation.
