1 b. When any sign for which a permit is required is removed, the zoning administra- <br />2 tor shall be notified and the entire sign and its components shall be removed. <br />3 c. The permit owner shall be responsible for all of the requirements of this section, <br />4 including the liability for expense of removal and maintenance incurred by the <br />5 city. <br />6 Sec. 108-310 — Off -premises digital billboard signs. <br />7 (1) Findings, purpose, and intent. The city council finds it necessary for the promotion and <br />8 preservation of the health, safety, welfare, and aesthetics of the community that the con- <br />9 struction, location, size, conspicuity, brightness, legibility, operational characteristics, <br />10 and maintenance of off -premises digital billboard signs be controlled. Off -premises digi- <br />11 tal billboard signs have a direct and substantial impact on traffic safety, pedestrian <br />12 safety, community aesthetics and property values. If left uncontrolled, off -premises digi- <br />13 tal billboard signs, designed to catch the eye of persons in their vicinity and hold it for ex- <br />14 tended periods of time, including video display signs, constitute a serious traffic safety <br />15 threat. The city council intends by this subsection to establish a legal framework for off- <br />16 premises digital billboard sign regulation in the city to facilitate an easy and agreeable <br />17 communication between people while protecting and promoting the public health, safety, <br />18 welfare and aesthetics of the community. It is not the purpose or intent of this subsection <br />19 to prefer or favor commercial messages or speech over noncommercial messages or <br />20 speech or to discriminate between types of noncommercial speech or the viewpoints <br />21 represented therein. Rather, the purpose of the off -premises digital billboard sign regula- <br />22 tions promulgated in this subsection is: <br />23 a. To eliminate potential hazards to motorists and pedestrians using the public <br />24 streets, sidewalks, and rights -of -way; <br />25 b. To safeguard and enhance property values; <br />26 c. To control nuisances; <br />27 d. To preserve and improve the appearance of the city through adherence to aes- <br />28 thetic principles, in order to create a community that is attractive to residents and <br />29 to nonresidents who come to live, visit, work, or trade; <br />30 e. To eliminate excessive and confusing sign displays; <br />31 f. To encourage signs which by their design are integrated with and harmonious to <br />32 the surrounding environment and the buildings and sites they occupy; <br />33 g. To maintain the character of the main -street core downtown but allow local busi- <br />34 nesses the opportunity to reach a wider audience by advertising along Highway <br />35 10; and <br />36 h. To promote the public health, safety, and general welfare. <br />37 (2) Location of off -premises digital billboard signs. Notwithstanding anything to the contrary <br />38 contained within this Code, off -premises digital billboard signs may be located only <br />39 within the off -premises digital billboard sign overlay district. Off -premises digital billboard <br />40 signs are prohibited in all zoning districts of the city other than the off -premises digital <br />41 billboard sign overlay district. Off -premises digital billboard signs located in the off-prem- <br />42 ises digital billboard sign overlay district must comply with all Code requirements for per- <br />43 mitted off -premises digital billboard signs. <br />44 a. Permitted districts. The off -premises digital billboard sign overlay district shall <br />45 commence along Highway 10 within 250 feet of the Highway 10 centerline within <br />Page 27 of 30 <br />
