6. 1. <br />CC Regular Session <br />Meeting Date: <br />05/13/2025 <br />Primary Strategic Plan Initiative: Promote economic growth and development. <br />Title: <br />PUBLIC HEARING: Consider a request for an Easement Vacation in HY-10 Ramsey 2nd Addition and Final Plat <br />of "Kwik Trip 1782." <br />Purpose/Background: <br />Kwik Trip (the "Applicant") has submitted a Land Use Application for the development of a portion of the <br />7.07-acre parcel at the southwest corner of Armstrong Boulevard NW and Bunker Lake Boulevard NW (the <br />"Subject Property"). The conditional use permit for the Motor Fuel Station and Car Wash uses in the B-2, <br />Community Business Zoning District will be heard by Planning Commission on Thursday, May 22nd. Tonight's <br />portion of the request pertains to two items: an Easement Vacation to vacate all current easements on the Subject <br />Property, and a Final Plat to subdivide the property that currently straddles Ferret Street to create a 3.35-acre lot <br />for Kwik Trip. It should be noted that the Final Plat will re -dedicate all necessary drainage and utility easements, <br />largely in the same locations as the current easements being vacated. The Easement Vacation simply cleans up the <br />legal descriptions for the new redevelopment. <br />Notification: <br />Staff attempted to notify property owners within 700 feet of the Subject Property, as reflected in the Anoka <br />County Property Records, of the request and the Public Hearing for the Easement Vacation. A notice of the <br />Public Hearing will be published in the Anoka County Union Herald, the City's official newspaper. Staff also <br />attempted to notify all small utility providers in the area of the proposed Easement Vacation. A proposed <br />development sign was placed on the property. <br />A separate Public Hearing notice will be published and sent out to notify property owners within 350 feet of the <br />Subject Property of the Conditional Use Permit request to be heard by Planning Commission on Thursday, May <br />22nd. <br />Time Frame/Observations/Alternatives: <br />Easement Vacation <br />As noted above, Staff attempted to notify all small utility providers in the area of the Easement Vacation request. <br />At the time of writing this case, Staff have only received one response from Lumen regarding existing buried <br />cable, but that cable will be located in a new drainage and utility easement along the south side of Bunker Lake <br />Boulevard. Other utility companies, including CenterPoint Energy and Comcast, confirmed that they each do not <br />have facilities in the vacated area. It should be noted that all vacated easements will be replaced with <br />newly -platted easements with the "Kwik Trip 1782" Final Plat. This cleans up the legal descriptions for <br />easements, and thus makes the process simpler for staff and utility providers in the future. <br />Final Plat <br />The proposed plat of "Kwik Trip 1782" is considered a minor plat that subdivides an existing platted parcel into <br />two new buildable lots, each located on opposite sides of Ferret Street. It will also re-establish the right-of-way for <br />Ferret Street that was obtained via easement documents. Upon recording of the Final Plat, Kwik Trip's new legal <br />description will be "Lot 1, Block 2, Kwik Trip 1782, Anoka County, Minnesota", and this lot will be wholly <br />located within the B-2, Community Business zoning district.. The other lot west of Ferret Street, to be legally <br />described as "Lot 1, Block 1, Kwik Trip 1782", is anticipated to be replatted in the future with the adjacent <br />property to the west as part of the larger BLIP industrial development. That lot will be wholly located within the <br />I-1, Light Industrial zoning district. <br />
