1 construction, location, size, conspicuity, brightness, legibility, operational characteristics, <br />2 and maintenance of off-premises digital billboard signs be controlled. Off-premises digi- <br />3 tal billboard signs have a direct and substantial impact on traffic safety, pedestrian <br />4 safety, community aesthetics and property values. If left uncontrolled, off-premises digi- <br />5 tal billboard signs, designed to catch the eye of persons in their vicinity and hold it for ex- <br />6 tended periods of time, including video display signs, constitute a serious traffic safety <br />7 threat. The city council intends by this subsection to establish a legal framework for off- <br />8 premises digital billboard sign regulation in the city to facilitate an easy and agreeable <br />9 communication between people while protecting and promoting the public health, safety, <br />10 welfare and aesthetics of the community. It is not the purpose or intent of this subsection <br />11 to prefer or favor commercial messages or speech over noncommercial messages or <br />12 speech or to discriminate between types of noncommercial speech or the viewpoints <br />13 represented therein. Rather, the purpose of the off-premises digital billboard sign regula- <br />14 tions promulgated in this subsection is: <br />15 a. To eliminate potential hazards to motorists and pedestrians using the public <br />16 streets, sidewalks, and rights-of-way; <br />17 b. To safeguard and enhance property values; <br />18 c. To control nuisances; <br />19 d. To preserve and improve the appearance of the city through adherence to aes- <br />20 thetic principles, in order to create a community that is attractive to residents and <br />21 to nonresidents who come to live, visit, work, or trade; <br />22 e. To eliminate excessive and confusing sign displays; <br />23 f. To encourage signs which by their design are integrated with and harmonious to <br />24 the surrounding environment and the buildings and sites they occupy; <br />25 g. To maintain the character of the main-street core downtown but allow local busi- <br />26 nesses the opportunity to reach a wider audience by advertising along Highway <br />27 10; and <br />28 h. To promote the public health, safety, and general welfare. <br />29 (2) Location of off-premises digital billboard signs. Notwithstanding anything to the contrary <br />30 contained within this Code, off-premises digital billboard signs may be located only <br />31 within the off-premises digital billboard sign overlay district. Off-premises digital billboard <br />32 signs are prohibited in all zoning districts of the city other than the off-premises digital <br />33 billboard sign overlay district. Off-premises digital billboard signs located in the off-prem- <br />34 ises digital billboard sign overlay district must comply with all Code requirements for per- <br />35 mitted off-premises digital billboard signs. <br />36 a. Permitted districts. The off-premises digital billboard sign overlay district shall <br />37 commence along Highway 10 within 250 feet of the Highway 10 centerline within <br />38 the Ramsey city limits. Off-premises digital billboard signs are not allowed in any <br />39 residential or planned unit development (PUD) zoning district. <br />40 b. Number of off-premises digital billboard signs. A total of three off-premises digital <br />41 billboard signs shall be permitted within the entirety of the off-premises digital bill- <br />42 board sign overlay district. <br />43 c. Separation distance between off-premises digital billboard signs. Off-premises <br />44 digital billboard signs shall have a separation distance of at least two miles be- <br />45 tween each site in which they are located. <br /> <br />Attachment A – Ordinance #25-07 <br />Page 28 of 30 <br /> <br /> <br />
