Background: <br />REQUEST TO REZONE PROPERTY FROM B -2 BUSINESS TO <br />PLANNED UNIT DEVELOPMENT (PUD); <br />CASE OF DPM INVESTMENTS, INC <br />By: Amy Geisler, AICP, Associate Planner <br />DPM Investments, Inc. has applied for a rezoning from B -2 Business to Planned Unit <br />Development (PUD) on the property located on the east side of Ebony Street just south of the <br />Super Bowl. <br />The following items are enclosed for your information: <br />a) Site location map <br />b) Zoning/land use exhibit <br />c) Proposed findings of fact <br />d) Proposed ordinance <br />*Meeting minutes are included with the Comprehensive Plan Amendment case* <br />Notification: <br />Property owners within 700 feet were notified of the public hearing. <br />Observations: <br />CASE # <br />The applicant is proposing to develop 6 twinhome units (3 two -unit buildings) on the subject <br />property. The property is located within the Mississippi River Overlay District, but over 800 feet <br />from the river itself. City Staff is in the process of updating the Overlay District requirements. <br />The draft code and the Comprehensive Plan require all new development in the river corridor to <br />be processed as a Planned Unit Development, in order to allow some flexibility in the design of <br />new development while protecting the river ecology. <br />The submitted preliminary plat and preliminary site plan were evaluated according to current R -2 <br />Medium Density Residential standards for twinhomes. The plan meets all requirements with the <br />exception of lot width. The R -2 District requires a 50 -foot lot width, and the plan shows five 40- <br />foot lots and one 44 -foot lot. The lot width deviation is permitted if the rezoning request to PUD <br />is approved. <br />As noted in the Comprehensive Plan Amendment case, the City Council discussed Ebony Woods <br />at the October 10, 2006 work session and directed the developer to prepare revised building <br />elevations, which are discussed in the preliminary plat case. <br />5 <br />-191- <br />
