CC Regular Session <br />Meeting Date: <br />06/10/2025 <br />Primary Strategic Plan Initiative: Promote economic growth and development. <br />Title: <br />6. 1. <br />PUBLIC HEARING: Adopt Resolution #25-130 Vacating Right -of -Way Easements in Trott Brook Crossing. <br />Purpose/Background: <br />173rd Avenue NW is a rural unpaved roadway that provides access to the Trott Brook Crossing subdivision, <br />North Brook Meadows (preliminary Plat approved in 2022), and one private residence (7031 173rd Avenue <br />NW). The approved preliminary plat of Trott Brook Crossing included a realignment of 173rd Avenue and will <br />be dedicated in the upcoming plat of Trott Brook Crossing 3rd Addition. The south half of the right-of-way is <br />proposed to be vacated and helps facilitate that realignment. The northern half will be brought forward for <br />vacating as the North Brook Meadows final plat comes forward (expected Fall 2025). The north half has no <br />bearing on the Trott Brook Crossing 3rd Addition application. <br />There are two portions of this right-of-way proposed to be vacated. The western portion was dedicated via an <br />easement granted by quitclaim deed. The eastern portion appears to be granted through prescriptive rights and <br />re -affirmed with the first plat of Trott Brook Crossing. <br />The one private residence will lose direct frontage to 173rd Avenue as the roadway is realigned. The resident is <br />the seller of the land that was platted as Trott Brook Crossing and has been working with the developer on <br />relocating the driveway until such time that the North Brook Meadows property north of 173rd Avenue and to the <br />east of 7031 can provide a permanent access. In the meantime, Lot 6, Block 2, Trott Brook Crossing 3rd Addition <br />will be set aside to provide a driveway connection to the rerouted 173rd Avenue. <br />Notification: <br />Public notice was placed in the May 9 Anoka Union Hearld Newspaper. Private utility companies were emailed <br />the public hearing notice and vacation exhibits 30 days prior to tonight's hearing. Mailed notices were sent to <br />property owners within 350 feet. <br />Of the responding utility companies, Lumen noted that they have facilities in that corridor. The applicant is <br />working with them on relocation with the new street alignment. <br />Funding Source: <br />All costs associated with this request are the responsibility of the applicant. <br />Recommendation: <br />Staff recommend vacating the right-of-way as requested by the applicant. <br />Outcome/Action: <br />Motition to adopt Resolution #25-130 Vacating Right -of -Way in Trott Brook Crossing <br />Attachments <br />Location Map <br />Resolution #25-130 <br />
