Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #25-130 <br />RESOLUTION VACATING RIGHT-OF-WAY IN TROTT BROOK CROSSING <br />RECITALS <br />WHEREAS, TCLD Fund One Trott Brook, LLC (the "Applicant") has requested the <br />vacation of the Right -of -Way for 173rd Avenue Northwest, including public roadway, utility, and <br />trail easements, on the property legally described as: <br />Outlot H, Trott Brook Crossing, Anoka County, Minnesota <br />(the "Subject Property"); and <br />WHEREAS, a public hearing, pursuant to Section 106-260 (Easement Vacation) of the <br />Ramsey City Code and Section 12.6 of the City Charter, was held on June 10, 2025, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are available; <br />and <br />WHEREAS, the right-of-way will be replaced with dedicated right-of-way with the <br />recording of the plat known as Trott Brook Crossing 3rd Addition; and <br />WHEREAS, the Ramsey Engineering Department has reviewed the request and has no <br />objection to the easement vacation. <br />WHEREAS, some utility companies have noted that they may have facilities, partially, in <br />the affected area. <br />FINDINGS OF FACT <br />1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br />2. That the easement vacation is necessary to accommodate a realignment of 173rd Avenue NW. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants the vacation of the right-of-way for 173rd <br />Avenue Northwest as follows: <br />a. All of the easements, including public roadway, utility, and trail easements <br />described in Document Number 2036331.005, Anoka County, Minnesota (see <br />Exhibit A); and <br />
