Absent: Commissioners Brauer and Levine. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />The following Council minutes were noted: <br /> <br />1) City Council regular meeting minutes dated August 22, 2006 <br />2) City Council regular meeting minutes dated September 11, 2006 <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Request for an Amended Conditional Use Permit for Northern Counties <br />Secretarial; Case of Carol Lublin <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:11 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearine: <br /> <br />Chairperson Nixt called the public hearing to order at 7:11 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik stated Northern Counties Secretarial Services <br />is located at 6139 157th Lane N.W. The property is zoned R-l Residential. In 1991, the City <br />Council issued a Conditional Use Permit to Carol Lublin to occupy the vacant building with her <br />secretarial service, other professional offices, and daycare services. The Conditional Use Permit <br />allowed Ms. Lublin the opportunity to increase the building area on the site up to 22,000 square <br />feet without the need for additional amendments to the Conditional Use Permit. In addition, the <br />Conditional Use Permit established a 120-foot structure setback from the north and east property <br />lines. The intent of this setback was to provide a buffer between existing residents and any <br />future expansions of her commercial operations. To date, the building has not been expanded <br />and no daycare service has been established at the site. <br /> <br />Assistant Community Development Director Frolik explained Louis and Jacqueline Abendroth <br />reside on the adjacent lot to the north. Their driveway extension encroaches on Ms. Lublin <br />property by approximately 5 feet. The Abendroths have been leasing a 10- foot strip from Ms. <br />Lublin along the common property line since 1993. The Abendroths would like to own that 10 <br />feet and make their driveway lawful conforming. Ms. Lublin is willing to deed the property to <br />Abendroths but is requesting a lO-foot reduction in the structure setback established in her <br />Conditional Use Permit in lieu of the land conveyance. Ms. Frolik indicated the draft <br />Conditional Use Permit would replace the permit issued in 1991. All of the applicable terms <br />from 1991 have been carried over into the new permit.
