Mr. Jensen
noted that City Code allows for a 5 foot side yard setback on the garage
side of the home; the home his clients have chosen has living space above
the garage and he is therefore restricted to the 10 foot side yard setback.

Ms. Norris noted that Mr. Jensen would not need a variance if the subject
lot was as wide as other lots in the Flintwood Hills PUD.

Motion by Commissioner Zimmerman and seconded by Commissioner Holm to adopt
Findings of Fact 0199 relating to Mr. Joseph Jensen's request for a
variance. (Please refer to findings of fact file for Findings of Fact
0199).

Motion carried. Voting Yes: Vice Chairman Hendriksen, Commissioners HOlm,
Zimmerman and LaDue. Voting No: None. Absent: Commissioners Howell,
ShtmlWay and Terry.

Motion by Commissioner Holm and seconded by Commissioner Zimmerman to
Board of Adjustment/March 24, 1988
