Absent: Commissioners Howell <br />and Hendriksen. <br /> <br />Case #2: Request For Variance From Section 170.015G Of The City Code <br />To Construct An Accessory Structure Taller Than Pe~mitt~d: <br />Case Of Mr. Gerald Ackerman: <br /> <br />Mr. Ackerman noted that his accessory structure would be taller than 16 <br />feet but not taller than the home on the pro};:erty. The structure would be <br />used to store personal vehicles and equipment. The height is needed to <br />accommodate 10 foot sidewalls so that a 1.5 ton truck can be stored in the <br />building. <br /> <br />Commissioner LaDue noted that State law requires that variances be granted <br />on the basis of hardship and that he sees no hardship in this case. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to amend <br />the proposed findings of fact as follCMS: <br /> <br />Add Item #12 - That there has been no demonstration of a hardship <br />provided by the Applicant. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, LaDue and Holm. Voting No: None. Absent: Commissioners Howell <br />and Hendriksen. <br /> <br />Motion by Commissioner Zimmerman and seconded by. Commissioner LaDue to <br />adopt Findings of Fact 0206, as amended, relating to Mr. Gerald Acke rman ' s <br />request for a variance. (Please refer to findings of fact file for <br />Findings of Fact 0206) . <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, LaDue and Holm. Voting No: None. Absent: Commissioners Howell <br />and Hendriksen. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Holm to deny <br />Mr. Gerald Zckerman's request for a variance based on the findings of fact. <br /> <br />Motion carried. voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Terry, LaDue and Holm. Voting No: None.
