Board of Adjustment public hearing minutes dated February 26, 1987 <br />regarding Mr. Lyle MCLaughlin's request for a variance to side <br />yard setback. <br /> <br />2. Board of Adjustment regular meeting minutes dated February 26, <br />1987 . <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Shumway, LaDue, Hendriksen and Peterson. Voting No: None. Absent: <br />Comnissioner Howell. <br /> <br />OOARD OF ADJUS'l'MENI' BUSINESS <br /> <br />Case il: Request For Variance From Mississip.,pi River Setback: Case Of <br />Mr. John ftWrn;:il = <br /> <br />Mr. Myrdal stated that he is requesting a variance from the Mississippi <br />River setback for Lots 18 and 19 in Bowers Mississippi Acres. Mr. Myrdal <br />noted that the prop:>sed location of his house is in line with the homes on <br />the two adjacent properties; that if he follows setback restrictions, his <br />hane would be 70' behind the two adjacent homes. Mr. Myrdal stated that <br />the Building Inspector and DNR have reviewed the site and agree that the <br />prop:>sed location for the house is the best. <br /> <br />Ms. Norris confirmed that John Stine of DNR has no objections to Mr. <br />Myrdal's request. <br /> <br />Motion by Commissioner Peterson and seconded by Commissioner Deemer to <br />adopt Findings of Fact 0157, amended as follows, relating to Mr. John <br />Myrdal's request for a variance fran the Mississippi River setback: <br /> <br />Add Item #17 to read as follows: 'That the prop:>sed setback is above <br />the high water mark.' <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Shumway, LaDue, Hendriksen and Peterson. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Comnissioner Howell arrived at this time. <br /> <br />Mr. Myrdal stated that he has no objections to the terms of the variance <br />agreement. <br /> <br />Motion by Commissioner Peterson and seconded by Commissioner LaDue to <br />approve Mr. John Myrdal' s request for a variance, amended as follows, from <br />the required Mississippi River setback. <br /> <br />Add Item #6 to read as follows: 'That the granting of this variance <br />is contingent upon the applicant completing a minor platting as <br />Board of Adj ustment/March 26, 1987 <br /> <br />Page 2 of 4 <br />
