BUSINESS <br /> <br />Case 411: Request FoiVariance From Accessory Stiuc tureMaximum Height <br />AlloW'ance;Case Of Mr. Jeff Erikson: <br /> <br />Mr. Erikson was present. <br /> <br />Chairman Zimmerman noted that the City Attorney has determined that even <br />though the property is located in the B-1 Business districtt the principal <br />use of the property is residential; thereforet Mr. Erikson's accessory <br />structure should be subject to residential standards. <br /> <br />Ms. Norris noted that the 16 foot height limitation for accessory <br />structures applies to commercial and industrial zones as well as <br />residential zones. Ms. Norris also noted that the City Attorney has also <br />stated that if Mr. Erikson desires to use the accessory structure for <br />commerica1 purposes, he would have to go through the conditional use <br />process because his primary use of the property is residential. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to <br />adopt Findings of Fact 0160 relating to Mr. Erikson's request for a <br />variance from the maximum height allowance for accessory structurest <br />amended as follows: <br /> <br />Item #8 - Should read as follows: 'That the Applicant is proposing <br />to construct an accessory structure approximately 22 feet in heightt <br />which is also higher than the principal structure.' <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemert <br />Hendriksen and Peterson. Voting No: None. Absent: Commissioners Howell, <br />Shumway and LaDue. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to <br />denYt based on the findings of factt Mr. Erikson's request for a variance <br />from the maximum height allowance for accessory structures. <br /> <br />Motion carried.
