<br />Councilmember Peters introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #25-130 <br /> <br />RESOLUTION VACATING RIGHT-OF-WAY IN TROTT BROOK CROSSING <br /> <br />RECITALS <br /> <br />WHEREAS, TCLD Fund One Trott Brook, LLC (the “Applicant”) has requested the <br />rd <br />vacation of the Right-of-Way for 173 Avenue Northwest, including public roadway, utility, and <br />trail easements, on the property legally described as: <br /> <br /> Outlot H, Trott Brook Crossing, Anoka County, Minnesota <br /> <br /> (the “Subject Property”); and <br /> <br />WHEREAS, a public hearing, pursuant to Section 106-260 (Easement Vacation) of the <br />Ramsey City Code and Section 12.6 of the City Charter, was held on June 10, 2025, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are available; <br />and <br /> <br />WHEREAS, the right-of-way will be replaced with dedicated right-of-way with the <br />rd <br />recording of the plat known as Trott Brook Crossing 3 Addition; and <br /> <br />WHEREAS, the Ramsey Engineering Department has reviewed the request and has no <br />objection to the easement vacation. <br /> <br />WHEREAS, some utility companies have noted that they may have facilities, partially, in <br />the affected area. <br /> <br />FINDINGS OF FACT <br /> <br />1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br /> <br />rd <br />2. That the easement vacation is necessary to accommodate a realignment of 173 Avenue NW. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />rd <br />1) That the Ramsey City Council hereby grants the vacation of the right-of-way for 173 <br />Avenue Northwest as follows: <br /> <br />a. All of the easements, including public roadway, utility, and trail easements described <br />in Document Number 2036331.005, Anoka County, Minnesota (see Exhibit A); and <br /> <br /> <br />
