Councilmember Peters introduced the following resolution and moved for its adoption: RESOLUTION #25-130 RESOLUTION VACATING RIGHT-OF-WAY IN TROTT BROOK CROSSING RECITALS WHEREAS, TCLD Fund One Trott Brook, LLC (the “Applicant”) has requested the rd vacation of the Right-of-Way for 173 Avenue Northwest, including public roadway, utility, and trail easements, on the property legally described as: Outlot H, Trott Brook Crossing, Anoka County, Minnesota (the “Subject Property”); and WHEREAS, a public hearing, pursuant to Section 106-260 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City Charter, was held on June 10, 2025, and that said public hearing was properly advertised and that the minutes of said public hearing are available; and WHEREAS, the right-of-way will be replaced with dedicated right-of-way with the rd recording of the plat known as Trott Brook Crossing 3 Addition; and WHEREAS, the Ramsey Engineering Department has reviewed the request and has no objection to the easement vacation. WHEREAS, some utility companies have noted that they may have facilities, partially, in the affected area. FINDINGS OF FACT 1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. rd 2. That the easement vacation is necessary to accommodate a realignment of 173 Avenue NW. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: rd 1) That the Ramsey City Council hereby grants the vacation of the right-of-way for 173 Avenue Northwest as follows: a. All of the easements, including public roadway, utility, and trail easements described in Document Number 2036331.005, Anoka County, Minnesota (see Exhibit A); and
