Mr. Hunt noted that the home already encroaches the <br />side yard because the home was built prior to setbacks being established. <br /> <br />Ms. Norris stated that John Stine of DNR has reviewed the request and has <br />no objections to it. <br /> <br />The Board proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to <br />adopt Findings of Fact 0171, amended as follows, relating to Mr. Jack <br />Newcomb's request for a variance from Section 170.016B of the City Code: <br />(Refer to findings of fact file for Findings of Fact 0171). <br /> <br />Add Item #14 to read as follows: "That the Applicant's representative <br />stated that the house was constructed prior to enactment of side yard <br />setback requirements." <br />Board of Adjustment/July 2, 1987 <br /> <br />Page 2 of 4 <br />
