<br />. <br /> <br />. <br /> <br />. <br /> <br />BOARD OF ADJUSTMENT <br />PUBLIC HEARING <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />The Ramsey Board of Adjustment conducted a public hearing on Thursday, <br />September 24, 1987 at the Ramsey Municipal Center, 15153 Nowthen Blvd. <br />N.W., Ramsey, Minnesota regarding Mr. Marshall Pearson's (Regency Homes) <br />request for a variance from SAection 170.076.24 of the City Code regarding <br />setback from the Rum River. <br /> <br />Members Present: Mr. Gerald Zimmerman, Chairman <br />Mr. Roy Shumway <br />Mr. Charles LaDue <br />Mr. Michael Terry <br />Mr. Jim Holm <br />Mr. Terry Hendriksen <br /> <br />Also Present: <br /> <br />Community Development Director Anne Norris <br /> <br />Members Absent: <br /> <br />Mr. Jim Howell <br /> <br />CALL TO ORDER <br /> <br />Chairman Zimmerman called the public hearing to order at 7:42 p.m. <br /> <br />CITIZEN INPUT <br /> <br />Mr. John Stine - Area Hydrologist - Department of Natural Resources - Noted <br />his memo to the City of Ramsey Wild and Scenic River File dated September <br />16,1987 regarding Regency Homes Variance, Lot 3, Reilley Estates 2nd <br />Addition. <br /> <br />Mr. Stine stated that earlier this spring, during construction of the home, <br />he was requested by Ramsey's Building Official to review the location of <br />the structure. It was determined that the code had been misinterpreted; <br />setback requirements are 150 feet from the river or 30 feet from the bluff, <br />whichever is greater; Mr. Erickson interpreted the setback to be either 150 <br />feet from the river or 30 feet from the bluff; as a result, the structure <br />is 30 feet from the bluff but only 70 feet from the river. At this time, <br />construction was almost complete and removal of the structure was not a <br />reasonable course of action. Representatives of Regency Homes were <br />requested to consider landscaping items to screen the structure from the <br />river's view. Since that time, the pending sale of the home fell through, <br />none of the landscaping items were done and heavy rains caused erosion and <br />the deposit of sediment in the river. It was then decided that an after- <br />the-fact variance should be pursued by Regency Homes to legally address <br />problems on the site. The Soil and Water Conservation District provided <br />recommendations for erosion corrections and DNR supports those <br />recommendations in addition to SOme recommendations of their own.
