<br />. <br /> <br />. <br /> <br />. <br /> <br />Bruce West stated that no citizens appearing at the public hearing must <br />indicate apathy or no opposition on the part of Mr. Brettschneider's <br />neighbors. <br /> <br />Chairman Shumway noted that the Board has to deal with laws and not what <br />neighbors think. <br /> <br />Commissioner Zimmerman explained that if the need would ever arise, the <br />Board would have to be able to satisfy the courts that a variance approval <br />was justified. <br /> <br />Mr. Brettschneider stated that a 5 angle lot is a hardship. <br /> <br />Commissioner Hendriksen stated that 5 angles were created by the plat and <br />therefore not a natural hardship; the plat was approved by the City and the <br />subject lot met city standards as far as square footage and frontage; the <br />hardship was created by the size of home built on the lot. <br /> <br />Motion by Commissioner LaDue to table any action on Mr. and Mrs. <br />Brettschneider's request for a variance to allow the applicant time to <br />supply any additional information that would constitute a hardship. <br /> <br />Mr. Brettschneider stated that he would prefer a decision so that he <br />can proceed to review other options available to him. <br /> <br />Motion by Commissioner Holm to approve Mr. and Mrs. Brettschneider's <br />request for a variance. <br /> <br />Motion failed for lack o!l5: second. <br /> <br />Motion by Chairman Shumway and seconded by Commissioner Hendriksen to deny <br />Mr. and Mrs. Brettschneider's request for a variance. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Hendriksen and Terry. Voting No: Commissioners Holm and LaDue. Absent: <br />Commissioner Howell. <br /> <br />ADJOURNMENT <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holm to adjourn <br />the special Board of Adjustment meeting. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Holm, <br />Zimmerman, Hendriksen, LaDue and Terry. Voting No: None.
