Voting Yes: Chairman Zimmerman, Cormnissioners Deemer, LaDue, <br />Hendriksen, Shumway and Peterson. Voting No: None. Absent: Commissioner <br />HCMell. <br /> <br />BOARD OF ADJUSTMENl' BUSINESS <br /> <br />Case #l: Reqllest For Variance From Height Restrictions For Accesso:r;:y <br />Structures: Case Of Mr. Gerald Bauer: <br /> <br />. <br /> <br />Mr. Gerald Bauer stated that he is ra;Iuesting a variance from the 16 I height <br />limit to construct a barn shaped accessory structure on his 8 acre parcel at <br />6131 Green Valley Road that will have a height of 23 I. Because of different <br />land elevations, the accessory structure height will not exceed that of the <br />principal structure on the property. <br /> <br />The Board proceeded to revie.w the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Peterson to adopt <br />Findings of Fact 0153, amended as follows, relating to Mr. Bauer's request for <br />a variance fram the height restrictions for accessory structures: (Please <br />refer to findings of fact file for Findings of Fact 0153). <br /> <br />Add: #14. That the mini-plat requested of Mr. Gerald Bauer by the <br />Planning and Zoning Canmission at a previous meeting is what <br />created the necessity for this variance ra;Iuest. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Canmissioners Deemer, LaDue, <br />Hendriksen, Shumway and Peterson. Voting No: None. Absent: Commissioner <br />HCMell. <br /> <br />The Board of Adjustment proceeded to revie.w the proposed Variance Agreement. <br /> <br />Motion by Commissioner Peterson and seconded by Commissioner Deemer to approve <br />Mr. Bauer's ra;Iuest for a variance to construct an accessory structure taller <br />than allCMed by City Code and to enter into the proposed Variance Agreement <br />amended as follCMS: <br /> <br />Item #3 shall read as follCMS: 'The accessory structure shall be <br />finished with materials so that it matches the principal structure <br />on the property.' <br /> <br />Add Item #4 to read as follCMS: 'That the accessory structure height <br />shall not exceed the elevation of the principal structure on the property.
