<br />. <br /> <br />. <br /> <br />. <br /> <br />earlier this evening; that only a variance to structure location is required. <br /> <br />Ms. Norris stated that the pro[X>sed findings of fact would have to be amended <br />as follows: <br /> <br />1) Reword Item U as follows: ''!hat the applicant has applied for a Board <br />of Adjustment variance to construct in the front yard. <br /> <br />2) Omit Items #'s 5, 6, 16, 17 and 18. <br /> <br />Motion ~ Councilmember Sorteberg and seconded ~ Councilmanber Reimann to <br />adopt Findings of Fact 0127, as amended, regarding Mr. Newcomb's request for a <br />variance for an accessory structure. (Please refer to findings of fact file <br />for Findings of Fact 0127). <br /> <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, <br />Councilmanbers Sorteberg, Cox and Reimann. Voting No: None. <br /> <br />Motion by Councilmember Sortebeg and seconded by Councilmanber Cox to approve <br />Mr. Roy Newcomb's request for a variance to construct an accessory structure in <br />his front yard contingent u[X>n Mr. Newcomb entering into a developnent <br />agreement wi th the Ci ty . <br /> <br />Motion carried. Voting Yes: Chairperson Schlueter, Mayor Heitman, <br />Councilrnembers Sorteberg, Cox and Reimann. Voting No: None. <br /> <br />['Lise #3 ~ Reauest For Reconsideration Of Variance FQr AccessQrv S~ructure <br />Lar9~r !ltlan Allow~d ~ Ci tv Code: Case Of Mr. And Mrs. Steven <br />Johnson: <br /> <br />Mrs. Johnson was present and stated that their original request was for a 1,280 <br />square foot galvanized metal building; they will limi t the size to 1,000 square <br />feet which will be consistent with the amended ordinance adopted earlier this <br />evening; the amended ordinance adopted eliminates metal accessory structures on <br />parcels 2-1/2 acres or less; options are to request a variance to material <br />types or withdraw the variance application and request a refund. <br /> <br />Mr. Goodrich noted that the amended ordinance does not become effective for 30 <br />days; the Johnson's could apply for a building permit for a metal structure but <br />the size limit would be 624 square feet. <br /> <br />Mrs. Johnson stated that she would like to withdraw her variance application <br />and requested that her $90.00 be refunded. <br /> <br />Motion ~ Councilmanber Reimann and seconded by Mayor Hei bnan authorizing that <br />Mr. and Mrs. Steven Johnson receive a $90.00 variance application refund should <br />they choose to withdraw their request. <br /> <br />Further Discussion: Councilrnember Cox noted that his · no' vote regarding the <br />intial Council action on this case was based on the material type being metal. <br />Mayor Hei bnan stated that in Council's ini tial action on this request, he voted <br />in sup[X>rt of the request; at that time material type was not a consideration <br />but now it is by virtue of the amended ordinance. <br />November 12, 1985 <br /> <br />Page 2 of 3 <br />
