.

.

.

Board of Adjustment
Page 2
February 26, 1979

Councilman Mickelson stated they are two different requests.

The contractor for Grosslein presented further plans for the proposed Grosslein
Beverage Building. He emphasized the loading docks on the new building as the
loading of trucks and the blockage of the street is the major concern. The plans
presented by the contractor they feel will eleviate this problem.

Mr. Dick Johnson stated he is an attorney representing the adjacent property
owners. He asked the Council look very closely at the area zoned commercial as
the D.N.R. had addressed concern for area residents. He also stated he felt any
new development would only compound the problem.

Motion by Councilman Cox to close the public hearing. Motion withdrawn.

Merle Anderson stated he felt the motion to close the public hearing is ludicrous.
M~. Ande~son stated also that Mr. Johnson does not represent them and that he has
spent many hours preparing for this hea~ing. Mr. Anderson asked to have an en-
gineers point addressed.

City Administrator Schnelle stated they have been and can be done after the public
hearing.

Mr. Merle Anderson stated that all businesses must provide parking spaces and in
his interpretation of the ordinance Mr. Grosslein would need 178 parking stalls
and asked how they can grant a variance for a setback in this case.

Mayor Gamec stated there seems to be a difference in the Industrial and Wholesale
aspect of the ordinance and everyone's interpretation of them.

City. Attorney Goodrich explained the difference in Industrial and Business.

Mr. Anderson stated they did not get a copy of a meeting with Mr. Grosslein and
the citizens of January 19, 1979 until this hearing date of February 26, 1979.

Mayor Gamec stated Mr. Anderson was presenting comments tonight as Mr. Grosslein
could.

Motion by Councilman Cox to close the public hearing. Motion died for lack of
second.

Mr. Anderson stated it seemed the Council was ignoring the rest of the D.N.R. 's
letter and concerning themselves with Items 1 & 2 and felt they should consider
the entire letter.

Mr. Anderson also asked again the Council address all the points in the engineers
report.

Mrs. Roger Dickenson, Sr. asked if there was a code describing the Industrial and
Business areas of the City.

Motion by Councilman Cox and seconded by Councilman Reimann to close the public
hearing.
