Mr. Chairman. is a formal motion to immediately intervene <br />as a party in the proceedings. The request for my motion is that in the petition that <br />has been filed by the appelants in this case references made to activities all edged by <br />Royal Esquire, Inc. and one of its employees. That Royal Esquire Realities has a <br />substantial interest in the property and the zoning activity that occurred. ,md I think <br />becuase of that fact that we should be a party of these proceedings and be permitted the <br />right that any other party has in the proceedings. I think that this affects us as much <br />as it does the City Council. which is another party and the people who have made this <br />petition. Maybe even more so. We have a substancial investment so far in the property <br />by:yway of tying up money. and I think we ought to be granted that right. Therefore. <br />I make a motion to intervene as a party. <br /> <br />Cox: Council do you have a copy? <br /> <br />Yes <br /> <br />CAN'T HEAR <br /> <br />Goodrich: Mr. Chairman, the statute indicates that any party may appear at the hearing <br />or by agent or attorney and may give testimony we substitute. Board willing. so that <br />Mr. Albert could be heard tongith. end he may be made a party to the proceeding. I'm <br />not sure to the substance or affedt whether or not he is not a party since I indicated <br />previously that we are not in a court proceeding; however. I think it is appropriate <br />that he do be a party and this motion be granted. <br /> <br />. Cox: What would be the proper manner for accepting this? <br /> <br />Goodrich: I would think that a motion by the Board. Since this is a procedural manner <br />I think that the Chairman could make this decision. <br /> <br />Cox: And just accept this? <br /> <br />Goodrich: Right. And subject to the Bocrds challenge. <br /> <br />Cox: We accept your motion then. <br /> <br />Albert: I have another motion. Mr. Chairman. This motion that I presented here was a <br />motion to disqualify a member of this panel from sitting. The petition that has been <br />filed before you and signed by Mr. Oliphant. and I believe. that his wife is sitting <br />in judicial position in judgement of a matter in which her husband appears of record as <br />the council. I think this is highly improper procedure. and I think that either she <br />should disqualify herself or he should disqualify himself as council for the petitioners. <br /> <br />CAN'T HEAR <br /> <br />Oliphant: I am in agreement with this also. <br /> <br />CAN'T HEAR <br /> <br />Goodrich: l1r. Chairman. Mrs. Oliphant on her own has disqualified herself. <br />
