<br />...- <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />-' ."" <br /> <br />PROPOSED RESOLUTION OF THE <br />ECONOMIC DEVELOPMENT COMMISSION <br />OF THE CITY OF RAMSEY <br /> <br />TO: <br /> <br />The City Council of the City of Ramsey <br /> <br />We recognize that it is your intent and purpose to work with the <br />business community of the City of Ramsey as a partnership for the <br />orderly growth and development of the economy within the city. It <br />has been our goal and objective to implement this purpose and, <br />consistent with that, we have met with your staff for the purpose <br />of enhancing the orderly growth and development and encouraging <br />the existing business enterprises in carrying out their business <br />activities. <br /> <br />It appears to us that a potentially major conflict is emerging in <br />the interpretation of your ordinances. As we understand it, the <br />broad general language that you adopted to give staff flexibility <br />in when they would request or demand an application for <br />conditional use permit was intended to give staff the opportunity <br />to enhance the "partnership" relationship between the City and <br />the business community. It now appears to us as your advisers <br />that staff are using this broad authority to insist on <br />conditional use permit applications in circumstances which seem <br />very inappropriate to those of us on the Commission. The staff's <br />interpretation of the broad language, "public health, safety, <br />convenience and welfare or to avoid traffic congestion or hazard <br />or other dangers or to promote conformity of a proposed use with <br />the character of adjoining property uses, and the district as a <br />whole, or to protect such character" is much more constrictive, <br />limited and confining than we on your Commission believe it <br />should'be. We also believe that it is a delegation of authority <br />which is so vague that it is unenforceable. <br /> <br />NOW, THEREFORE, in light of this conflict, we respectfully urge <br />and request the City Council to direct staff to refrain from any <br />further demands for conditional use permit applications under <br />this broad general language. We further request the Council to <br />direct staff to work with the Economic Development Commission in <br />redrafting ordinances in order to carry out the directive that <br />you have given your Commission and that staff be further <br />directed to submit back to the Council for its consideration such <br />revision of the ordinances as in the judgment of the Commission <br />would be appropriate. Once the ordinances have been redrafted, <br />then staff should be directed to carry out the directives of the <br />ordinances as redrafted. . <br /> <br />Dated this ~~ day of November, 1989. <br />
