Chairman Zimmerman replied that if the license is granted, it would be <br />under certain conditions and violation of those conditions would result in <br />the license being revoked. <br /> <br />Tim Klingbeil - Inquired how a 35' x 45' structure could be built without <br />a building permit; that such a structure and odors from the bears affects <br />adjacent property values. <br /> <br />Carlton Anderson - 6331 153rd Lane N..W. - Inquired if Mr. Guyer has <br />submitted the necessary information required for a wild animal license. <br />The placement of the enclosure does not meet specifications listed in the <br />wild animal ordinance; granting a variance would set a precedence. <br /> <br />Kathleen Anderson - 6331 153rd Lane N.W. - Inquired if citizens will be <br />allowed anymore input into this case beyond this public hearing. <br /> <br />Chairman Zimmerman replied that the Planning Commission will be making a <br />recommendation to City Council, taking into consideration public comments. <br /> <br />Mr. Guyer explained that the primary enclosure consists of a 3-sided, 35' x <br />45' cement block wall structure with the 4th side consisting of chain link <br />fencing; the secondary enclosure is an electrical fence looping around the <br />chain link side of the primary enclosure; there is a shelter area within <br />the block building for the bear. <br /> <br />Bill Wahl - 15403 Sunfish Lake Blvd. - Stated he lives directly across the <br />street from Mr. Guyer; that the bears are securely caged and he doesn't see <br />them as a threat; that without prior notice, he has visited the property <br />and never witnessed produce scraps lying about nor detected any bad odors. <br /> <br />Kathleen Anderson - Stated that the bear is allowed outside of the primary <br />enclosure and doesn't feel secure with an electrical fence, that is not <br />very high off the ground, being allowed as the secondary enclosure. <br /> <br />Mr. Guyer explained that beekeepers use the same 3-strand electrical fence <br />to keep bears out and it is just as effective for keeping bears in; the <br />bears are only allowed out of the primary enclosure under his supervision. <br /> <br />Mr. Carlton Anderson - Noted that according to the ordinance, the secondary <br />enclosure should entirely surround the primary enclosure. <br /> <br />Chairman Zimmerman noted receipt of the following written comments <br />regarding Mr. Guyer's request: <br /> <br />Mary Westphal - 6355 154th Lane N.W. - Opposing Mr. Guyer's request. <br />Jeff Wiles - 8453 176th Lane N.W. - In favor of Mr. Guyer's request. <br />Kathleen Anderson - 6331 153rd Lane - Opposing Mr. Guyer's request. <br /> <br />Jerry Martin - 6614 153rd Lane N.W. - Inquired as to Mr. Guyer's reason for <br />wanting to keep bears on his property. <br /> <br />Mr. Guyer replied that he keeps bears for his personal enjoyment and not <br /> Planning & Zoning Public Hearing/February 2, 1988 <br /> <br />Page 2 of 3 <br /> <br /> <br />
