<br />WHAT'S HAPPENING
<br />
<br />AT CITY HALL
<br />
<br />City Council met on November 15 and November 16 and
<br />approved redesignating use of 1985, 86, 87 and 88 Com-
<br />munity Development Block Grant funds to expand River's
<br />Bend Park to include a passive area for senior citizens and
<br />handicapped persons. Council adopted an amended
<br />Snowmobile Ordinance and urged the County to enact similar
<br />legislation for county roads. (A copy of the new snowmobile
<br />ordinance was featured in the November issue of the Ramsey
<br />Resident.) Council scheduled a public hearing for December
<br />13 regarding a proposed amendment to the City Charter to
<br />include a chapter entitled "Police Department". Council ap-
<br />proved Waste Management of Minnesota, Inc. 's request for
<br />a conditional use permit for vertical expansion of the landfill
<br />and development of a recreational ski hill. Council ap-
<br />propriated $5900 for funding assistance to the Northern
<br />Mayors Association. Council granted final plat approval to
<br />Riverview Estates (located south of Hwy. #10 and west of
<br />the Sunfish Lake Blvd. extension) with certain contingen-
<br />cies. Council approved Stanley Morton's request for a con-
<br />ditional use permit to have a business sign at his nursery
<br />sales lot in the Residential District. Council approved Mr. Bor-
<br />chert's request for a minor subdivision to plat Outlots C and
<br />D. Rodeo Hills, as platted buildable lots. Final plat approval
<br />was given to Bulow's Addition (located south of Hwy. #10
<br />and east of Sunfish Lake Blvd. extension) with certain con-
<br />tingencies. Council approved John Gobernatz' request for
<br />a minor subdivision of his property located south of Green
<br />Valley Road and east of Nowthen Blvd. Council discussed
<br />the possibility of requiring a joint environmental assessment
<br />worksheet for 3 proposed developments located east and
<br />south of Hunter's Hill. Council stated no objection to Ar-
<br />rigoni's request for a bingo operation at J.R. 's Entertain-
<br />ment Center. Council approved of Jim Gromberg attending
<br />the national Keep America Beautiful Convention in
<br />Washington, D.C. Council approved participation in the Min-
<br />nesota Police Recruitment System. Council approved Mr.
<br />Humbert's request to move a house and garage into Pineview
<br />Estates. Council appropriated $4300 for lobbying efforts pro-
<br />vided the agenda addresses Ramsey's concerns and needs.
<br />Council scheduled a public hearing for December 13 regar-
<br />ding an ordinance for no wake along the Rum River. Coun-
<br />cil approved the establishment of a Ramsey/ Anoka delega-
<br />tion to address issues which require potential agreement bet-
<br />ween Anoka and Ramsey. Council scheduled a special
<br />meeting for December 5 to discuss MUSA boundary amend-
<br />ments and establishment of an Economic Development
<br />Authority.
<br />
<br />City Council met on November 29 and approved rezoning
<br />Lots 2 and 3, Block 5, Riverside West, from Business to
<br />Residential. Council scheduled a public hearing for January
<br />10 regarding RRM Enterprises' application for an on-sale and
<br />Sunday Liquor license for On The Green. Council directed
<br />City Staff to prepare an ordinance amendment to the on-
<br />sale liquor license ordinance to decrease establishment size
<br />requirements. Council adopted a resolution transferring com-
<br />munity television programming responsibilities from Cable
<br />TV North Central to Quad Cities Cable Communications Com-
<br />mission. Council accepted the petition opposing the proposed
<br />improvement project for 156th Avenue and Hematite Street
<br />NW.; according to the City Charter, the project cannot be
<br />reconsidered for one year in it's present form. Council
<br />ordered a drainage study for the area east of Ramsey Blvd.,
<br />adjacent to 156th Avenue. Council accepted the resignation
<br />of Building Official Erickson. City Staff was directed to ob-
<br />tain a temporary easement from John Gobernatz in order
<br />to maintain 177th Avenue in it's current alignment until the
<br />road is upgraded and realigned into it's proper position.
<br />
<br />City Council met on December 5 and conducted a joint
<br />meeting with the Planning and Zoning Commission,
<br />Economic Development Commission and Economic Develop-
<br />ment Company regarding proposed amendments to the
<br />MUSA boundaries.
<br />
<br />Ramsey City Council and Burns Town Board conducted a
<br />publiC hearing on December 8 regarding proposed im-
<br />provements to Waco Street north of 179th Lane.
<br />
<br />City Council met on December 13 and referred the propos-
<br />ed ordinance for wake control back to the Lower Rum River
<br />Water Management Organization and recommended no
<br />restrictions on boat motor size but rather establishing no
<br />wake zones to control erosion. Council adopted an ordinance
<br />amending the City Charter to include a chapter entitled
<br />"Police Department". Hadtrath and Associates was selected
<br />as the insurance agent of record for the next 3 years. Coun-
<br />cil approved the purchase of 2 squad cars.
<br />
<br />COMMISSION MEETING NEWS
<br />
<br />The Planning and Zoning Commission met on December
<br />8 and recommended approval of Art Bulow's request to
<br />rezone Lots 2 and 3, Block 1, Bulow's Addition from Business
<br />to Residential. Regarding Rhonda Williams' request for a con-
<br />ditional use permit to maintain a horse hobby farm, the Com-
<br />mission directed City Staff to solicit an independent recom-
<br />mendation relative to the soundness, suitability and safety
<br />of Ms. Williams' operation; City Staff was also directed to
<br />prepare a map that would indicate the location of the sub-
<br />ject property in relation to the locations of those properties
<br />in favor of and those properties opposed to the Williams re-
<br />quest; the Building Official was directed to inspect the pro-
<br />perty and report to the Commission regarding the sound-
<br />ness of the barn and fencing and an adequate number of
<br />horses for the size of the property. The Commission recom-
<br />mended reappointment of Chairman Zimmerman and Com-
<br />missioners Hendriksen and Terry to the Commission. Chair-
<br />man Zimmerman and Commissioner Hendriksen were ap-
<br />pointed to the Ramsey/ Anoka Delegation.
<br />
<br />The Economic Development Commission met on November
<br />23 and reviewed progress on Star City tasks.
<br />
<br />The Economic Development Commission met on December
<br />14 and discussed the proposed realignment of Cty. Rd. #83
<br />and proposed amendments to the MUSA boundaries in rela-
<br />tion to the Mississippi River Bridge crossing.
<br />
<br />The Park and Recreation Commission met on December
<br />8 and recommended acquiring 75 feet of property along the
<br />north edge and cash to satisfy park dedication requirements
<br />forSybrant Addition located north of Whispering Pines, west
<br />of Cty. Rd. #83 and south of Whispering Pines Plat #3. The
<br />Commission recommended acquiring 75 feet along the south
<br />side of the property and one acre in the southwest corner
<br />to satisfy park dedication requirements for Sybrant 2nd Ad-
<br />dition located directly west of Whispering Pines Plat #3.
<br />Regarding the proposed Oak Run Addition east of Nowthen
<br />Blvd. and north of and including Coquina Street NW., the
<br />Commission recommended acquiring cash equal to 10% of
<br />the fair market value of the land to satisfy park dedication
<br />requirements. Mr. Dennis Peck was t the meeting to pre-
<br />sent North Fork's concept for development of a golf course
<br />in Northfork. Representatives were at the meeting to pre-
<br />sent a concept for a 13.5 acre land dedication to satisfy park
<br />dedication requirements for Windemere Woods, Cedar Hills
<br />and Chestnut Hills, all of which are located east and south
<br />of Hunter's Hill. Regarding replacing park land for Coun-
<br />tryside Estates, Staff noted two parcels of land in the vicini-
<br />ty that are available for purchase; the Commission recom-
<br />mended continuing negotiations on both of parcels, with one
<br />to be finally selected.

<br />PROPOSED ORDINANCE
<br />
<br />FOR MORATORIUM ON
<br />
<br />BURNING CERTAIN WASTES
<br />
<br />SECTION 1. PURPOSE AND FINDINGS.
<br />
<br />The purpose of this ordinance is to place a moratorium
<br />on burning of certain waste types by use of incinerators
<br />in the City of Ramsey. This ordinance is intended to
<br />allow the City time to conduct studies on the proper
<br />type of criteria necessary for the incineration of cer-
<br />tain waste types in the City. This purpose is impor-
<br />tant as the City Council finds that proper studies need
<br />to be conducted on this subject in order to protect
<br />the planning process and the health, safety and welfare
<br />of Ramsey's citizens.
<br />SECTION 2. AMENDMENT.
<br />
<br />Chapter 170 of the City Code is amended by addition
<br />of the following section:
<br />
<br />170.013F.2 INTERIM REGULATION
<br />
<br />a. NotWithstanding anything to the contrary in
<br />Chapter 170.01 of the City Code, no burn-
<br />ing of solid waste, hazardous waste, medical
<br />waste or special waste by use of an in-
<br />cinerator or hazardous waste incinerator shall
<br />be allowed within the City either as a per-
<br />mitted use or conditional use, nor will re-
<br />quests for such incineration burning be con-
<br />sidered by the City during the period of time
<br />the City is conducting studies on the develop-
<br />ment of criteria for the review and granting
<br />of requests for such incinerator burning.
<br />
<br />b. As used herein the following words shall have
<br />the meanings defined herein:
<br />
<br />"Hazardous Waste" means any refuse,
<br />sludge, or other waste material or combina-
<br />tions of refuse, sludge or other waste
<br />materials in solid, semi-solid, liquid, or con-
<br />tained gaseous form which .because of its
<br />quantity, concentration, or chemical,
<br />physical, or infectious characteristics may (a)
<br />cause or significantly contribute to an in-
<br />crease in mortality or an increase in serious
<br />irreversible, or incapacitating reversible il-
<br />lness; or (b) pose a substantial present or
<br />potential hazard to human health or the en-
<br />vironment when improperly treated, stored,
<br />transported, or disposed of, or otherwise
<br />managed. Categories of hazardous waste
<br />materials include, but are not limited to: ex-
<br />plosives, flammables, oxidizers, poisons, ir-
<br />ritants, and corrosives. Hazardous waste
<br />does not include source, special nuclear, or
<br />by-product material as defined by the Atomic
<br />Energy Act of 1954, as amended.
<br />
<br />"Hazardous Waste Incinerator" means an
<br />enclosed device using controlled flame com-
<br />bustion, a purpose of which is to thermally
<br />break down hazardous waste and that neither
<br />meets the criteria for classification as a boiler
<br />nor is listed or can be classified as an in-
<br />dustrial boiler.
<br />
<br />"Incinerator" means any furnace or other
<br />device used in the process of burning solid
<br />waste, hazardous waste, medical waste or
<br />special waste for the purpose of reducing the
<br />volume of the waste by removing combusti-
<br />ble material.
<br />
<br />"Solid Waste" means garbage, refuse, and
<br />other discarded solid materials, except
<br />animal waste used as fertilizer, including solid
<br />waste materials resulting from industrial,
<br />commercial, and agricultural operations, and
<br />from community activities. Solid waste does
<br />not include earthen fill, boulders, rock, and
<br />other materials normally handled in construc-
<br />tion operations, solids or dissolved material
<br />in domestic sewage, or other significant
<br />pollutants in water resources, such as slit,
<br />dissolved or suspended solids in industrial
<br />waste water effluents, dissolved materials in
<br />irrigation return flows, or other common
<br />water pollutants.
<br />
<br />c. Nothing contained herein shall prohibit the
<br />use of incinerator burning by incinerators
<br />lawfully permitted presently in use within the
<br />City.
<br />SECTION 3. AUTHORITY.
<br />
<br />This Ordinance is adopted pursuant to the authority
<br />granted to the City by Minn. Statutes, Section 462.355,
<br />Subd. 4.
<br />
<br />SECTION 4. TERM.
<br />
<br />This Ordinance shall, unless otherwise extended, ter-
<br />minate six (6) months from its effective date.
<br />SECTION 5. EFFECTIVE DATE.
<br />
<br />This Ordinance becomes effective upon its passage
<br />and thirty (30) days after its publication according to
<br />law, subject to City Charter Provision, Section 5.04.
