<br />OPTIONS FOR
<br />AIRPORT SAFETY ZONING
<br />
<br />A special election was held on April 1 9 and the voters
<br />indicated that they wished not to adopt airport safe-
<br />ty zoning. Before the City Council at this time is the
<br />question of what to do now. The reason the City look-
<br />ed at this issue is because there was, and still is,
<br />interest in paving the runway and improving the air-
<br />port with the assistance of Federal and State funds.
<br />The lack of airport safety zoning could affect Federal
<br />and State funding.
<br />
<br />On May 11, City Council held a special meeting with
<br />the Airport Commission to review the purpose of air-
<br />port zoning and options before the City now.
<br />
<br />Purposes:
<br />
<br />1) To protect the airport's environment from
<br />development encroachment during the period
<br />of study prior to establishing control or
<br />ownership.
<br />
<br />2) Preventing establishment of airport hazards in
<br />the approaches or immediate vicinity of the
<br />airport.
<br />
<br />3) Comply with state requirements for cost shar-
<br />ing eligibility.
<br />
<br />Options before the City Council:
<br />
<br />1) Determine what the results of the referendum
<br />election actually require. Section 5.07 of the Ci-
<br />ty Charter does not specifically state that an
<br />ordinance may not go into effect if it is voted
<br />down.
<br />
<br />2) Determine whether there may be a conflict bet-
<br />ween City Charter provisions on referendum
<br />and State Statute (Chapter 360.063, subds. 1
<br />and 2 as well as 360.064, subd. 1) which pro-
<br />vide the City with the right to zone for airport
<br />hazards.
<br />
<br />3) Make appropriate revisions to the Safety Zon-
<br />ing Ordinance and follow through the adoption
<br />process again.
<br />
<br />4) Request the Commissioner of Aeronautics to
<br />adopt the Safety Zoning Ordinance under State
<br />Statute Chapter 360.063, subd. 6.
<br />
<br />5) Determine whether the Safety Zoning Or-
<br />dinance might be invoked as an emergency
<br />ordinance.
<br />
<br />6) Proceed with airport improvement program un-
<br />til the City has ownership or control; then
<br />establish a Joint Airport Zoning Board with sur-
<br />rounding communities and adopt a safety zon-
<br />ing ordinance through the Joint Board.
<br />
<br />7) Implement a moratorium to protect the airport
<br />until such time that a safety zoning ordinance
<br />can be put into effect.
<br />
<br />8) "Do nothing." As long as the City Council re-
<br />tains it's status as the Airport Zoning Board and
<br />continues to work towards implementing airport
<br />zoning, it may not jeopardize the City's stan-
<br />ding with State requirements for funding.
<br />
<br />It was also brought to Council's attention that accor-
<br />ding to the initiative process in the City Charter, 10%
<br />of the registered voters can petition for adoption of
<br />the same Safety Zoning Ordinance that was voted
<br />down on April 19. If the Council acts on the Or-
<br />dinance within 10 days, the Ordinance is not sub-
<br />ject to a popular vote. However, under the referen-
<br />dum process in the City Charter, 10% of the
<br />registered voters could petition for an election to res-
<br />cind the ordinance.
<br />
<br />Obviously, some of the options listed above are more
<br />sensitive than others. City Council requested that the
<br />City Attorney review the options and report back to
<br />City Council on May 24.
<br />
<br />The Airport Commission also held a meeting on May
<br />11 and passed a motion to recommend that City
<br />Council execute the environmental information docu-
<br />ment to the regulatory agencies, take appropriate ac-
<br />tion to submit a pre-application to the FAA for fun-
<br />ding and submit input to Mn/DOT's 5 year capital
<br />improvements program document. The pre-
<br />application to FAA for funding and inclusion in
<br />Mn/DOT's 5 year capital improvement plan does not
<br />commit the City to accepting and spending funds.
<br />Council will take this recommendation under con-
<br />sideration on May 24 also.
<br />
<br />WHEN ARE
<br />
<br />RESIDENTIAL BUILDING
<br />
<br />PERMITS REQUIRED?
<br />
<br />Building permits are required for all buildings over
<br />120 square feet in roof area. All buildings, regardless
<br />of size shall meet the following setback criteria:
<br />
<br />Rural Area (area not served by municipal sewer
<br />and water)
<br />
<br />· 40 feet from front property line and not in front
<br />of principal residence.
<br />· 10 feet from side property line; 35 feet from
<br />side property line on corner lots or conform to
<br />adjacent setbacks, whichever is greater.
<br />· 5 feet from rear property line for detached
<br />buildings and 35 feet from rear property line
<br />for attached buildings. 200 feet from rear pro-
<br />perty line in Alpaca Estates river lots.
<br />
<br />River's Bend
<br />
<br />· 35 feet from front property line.
<br />· 10 feet from side property line on the house
<br />side and 5 feet on the garage side; 20 feet from
<br />side property line on corner lots or conform to
<br />adjacent setbacks, whichever is greater.
<br />· 20 feet from rear property line for attached
<br />buildings and 5 feet for detached buildings; 75
<br />feet from the ordinary high water mark of the
<br />river.
<br />
<br />Flintwood Hills Planned Unit Development
<br />
<br />· 30 feet from front property line.
<br />· 10 feet from side property line on the house
<br />side and 5 feet on the garage side; 20 feet from
<br />the side property line on corner lots or conform
<br />to adjacent setbacks, whichever is greater.
<br />· 20 feet from rear property line for attached
<br />buildings and 5 feet for detached buildings.
<br />
<br />Building permits are required for:
<br />
<br />Decks (new and rebuilt) that are more than 30 in-
<br />ches above ground or over any story or window
<br />below (main concern is not obstructing emergen-
<br />cy exit from a bedroom window). All decks shall
<br />be designed for 60 lb. loading and shall be of a
<br />decay resistent material, i.e. redwood, cedar,
<br />treated wood. Decks more than 30 inches above
<br />grade are required to have a 36 inch guardrail and
<br />spindles 6 inches on center.
<br />
<br />Screen porches and 3-season porches.
<br />
<br />Any further work after a building has had it's
<br />final inspection. i.e. finishing off unfinished areas
<br />of a building.
<br />
<br />Fences more than 6 feet in height. Permit applica-
<br />tion must include structural design and calcula-
<br />tions for wind load.
<br />
<br />Pools with a capacity of more than 5,000 gallons.
<br />Above ground pools less than 4 feet in height are
<br />required to be fenced or topped with a railing that
<br />will bring the height to at least 4 feet. All in-ground
<br />pools are required to be confined by at least a 4
<br />foot non-climbable fence with lock. Pools shall
<br />follow the same setbacks noted above.
<br />
<br />Septic System installation and repairs. Septic
<br />tanks and drainfields should be 10 feet from the
<br />house and property lines. (Note: Water wells
<br />should be 10 feet from property lines, 50 feet from
<br />septic tanks and 75 feet from drainfields).
<br />
<br />Repairs or installation of plumbing, heating
<br />and central air conditioners.
<br />
<br />Retaining walls more than 4 feet in height.
<br />
<br />A building permit is not required for:
<br />
<br />Driveway installation. However, driveways must
<br />be 3 feet from side property lines, no wider than
<br />20 feet at the point where it abuts the street and
<br />no higher than the level of the road pavement at
<br />the point where it abuts the road.
<br />
<br />Replacing siding, provided there is no structural
<br />reconstruction involved.
<br />
<br />Replacing shingles, provided no more than 3
<br />layers of material are involved and there is no
<br />structural reconstruction involved.
<br />
<br />Underground sprinkling systems.

<br />On parcels of land less than 2.5 acres in size, the
<br />attached or detached garage and accessory struc-
<br />tures shall be built with the same type construction
<br />design and materials as that of the principal struc-
<br />ture on the parcel. On parcels of land greater than
<br />2.5 acres in size, the accessory structures shall have
<br />a design and exterior finish which is compatible with
<br />the principal structure on the parcel and galvanized
<br />finishes are not permitted.
<br />The penalty which could be imposed for building
<br />without benefit of a permit is a double fee charged
<br />for the building permit, being charged with a
<br />misdemenaor with up to 90 days in jailor a $750 fine
<br />or both.

<br />The City of Ramsey is currently seeking can-
<br />didates to fill a vacancy on the Airport Commission.
<br />The position require a minimum of one evening
<br />meeting per month; familiarity with Ramsey City Or-
<br />dinances is desired. Ramsey residents interested in
<br />serving on the Commission are requested to sub-
<br />mit a letter of application to the Ramsey Municipal
<br />Center, 15153 Nowthen Blvd. N.W., Ramsey, Min-
<br />nesota 55303, no later than 5:00 P.M. on June 8,
<br />1988. The letter should contain the applicant's
<br />name, address, telephone number, work experience,
<br />education and any experience in municipal affairs.
<br />In addition, applicants should include a statement
<br />listing their reasons for seeking appointment to the
<br />Airport Commission. The position is not salaried.
