Chairperson Vogt stated if you want to split land you need to go to the Planning Commission and
there's criteria to be able to do that. Maybe we do one acre or we do 2 -1/2. We do have a fail
safe by them having to go to the Planning Commission.
Commissioner LaMere suggested "real — not homestead ".
Mr. Goodrich stated he would prefer to add to instead of changing the language.
Commissioner Simenson stated we have blocks of neighborhoods that will never be R -2 - non-
homestead — it does make sense.
Mr. Goodrich stated "or owners of real property larger than one acre is size whose real property
is not considered homestead ".
Commissioner Simenson stated "or owners of non - homestead real property greater than one acre
in size "; add that to 8.4.2 and 8.4.4.
Mr. Goodrich agreed,
Motion by Commissioner Swanson and seconded by Commissioner Simenson to send the
ordinance to the City Council for introduction and finally adoption, with the following
amendments: "For purposes of the foregoing sentence, "owners of real property" shall not
include owners of properties zoned for commercial or industrial uses or owners of real properties
non homesteaded, zoned residential greater than 10 acres in size based on zoning classifications
in effect at the date of such petition or owners of non - homesteaded real property larger than one
acre in size. The rest of the language will remain as Mr. Goodrich presented. If Council does
not pass this ordinance unanimously, it will come back to the City Charter with specific
comments.
All present in favor — Motion carried.
COMMISSION INPUT
1) Set Charter Agenda and Schedule Date(s) for Fall Meeting(s)
Chairperson Vogt reviewed the following list of topics:
a) Review of Chapter 4.5
b) Review of State Statute 410 and 412
c) Review of the City's Organizational Study; and
d) Receipt of the Model Charter discussed at the meeting with Kevin Frazell of the LMC
He noted that review of SS 410 and 412 is as time allows.
Commissioner Bertzyk pointed out that back in the January meeting it was discussed to invite
Bob Kirchner.
Charter Commission/May 22, 2006
M5
