<br />Case # 3 <br /> <br />Public Hearing <br />REQUEST FOR VARIANCE TO PARKING AND PAVING SETBACKS: <br />CASE OF HOLIDAY STATIONS TO RES <br /> <br />Background: <br /> <br />Holiday Stationstores has requested a variance to the 20 foot parking and paving setback <br />from a public right-of-way for the property located at the southeast comer of Ramsey <br />Boulevard and US Trunk Highway 10. This variance is being processed as part of the site <br />plan review process for the proposed Holiday gas station. <br /> <br />The following items are included in your packet: <br /> <br />1) Site Location Map <br />2) Variance exhibit <br />3) Proposed findings of fact <br />4) Proposed Variance Resolution <br /> <br />Public Hearing: <br /> <br />In accordance with City Code, property owners within 350 feet of the property were sent <br />a public hearing notice. <br /> <br />Observations: <br /> <br />City Code requires that all commercial and industrial developments maintain a 20 foot <br />green space between the public right-of-way and any paved areas. The intent of the Code <br />is to provide some areas for greenery along public roads for aesthetic and safety reasons. <br /> <br />Holiday Stationstores is proposing to deviate from this requirement on the <br />west/southwest comer of the site of the proposed gas station. The proposed site plan <br />indicates that a portion of the deviation will result from the increased right-of-way along <br />the comer edge of the property. The reason for obtaining this additional right-of-way was <br />to preserve adequate sight lines. The ROW was voluntarily donated by the applicant. In <br />the area not affected by the additional right-of-way, the setback deviation is <br />approximately 10 feet along the western edge of the property, just south of the access <br />point, for a total green space deficiency of approximately 600 square feet. This area is <br />required to accommodate truck movements in and around the site. <br /> <br />Recommendation: <br /> <br />The platting of additional right-of-way in the intersection of Riverdale Drive and Ramsey <br />Boulevard reduces the total lot area by approximately 1,200 square feet. This additional <br />right-of-way reduces the size of the lot, producing less area to provide green space on the <br /> <br />19 <br />
