Absent: None. <br /> <br />The public hearing was closed at 7:33 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:33 <br />p.m. <br /> <br />Chairperson Nixt indicated he would be more concerned about the application of the ordinance to <br />riparian areas. He asked how this ordinance operates in that context. <br /> <br />Civil Engineer II Linton replied silt fence will be required on all projects. There will be a <br />requirement for additional erosion control adjacent to streams; there is reference to the wetland <br />buffer ordinance in relation to setbacks. <br /> <br />Chairperson Nixt asked if the escrow or Letter of Credit amount is scaled for the type of <br />disturbance, such as for projects adjacent to riparian areas. <br /> <br />Civil Engineer II Linton responded in the affirmative. He indicated most of the problems are <br />related to single family development. There are provisions in the ordinance to allow the builder <br />or developer to provide additional monies to keep the balance up on the Letter of Credit if it is <br />expended during repairs. The developer or builder must fIrst be given the opportunity to <br />respond, but there is a measure included that allows the City to act if there is not a response <br />within a given period oftime. <br /> <br />Commissioner Brauer inquired about Section 9.27.04, Residential Construction Activities, which <br />states "TIus will also apply to multiple family units up to 12 Uluts per building that are part of an <br />approved plat." <br /> <br />Civil Engineer II Linton replied the ordinance focuses on the smaller residential properties. <br />Multiple family units more than 12 units would be more of an apartment building, which would <br />go through the site plan review process. The 12 unit townhomes are the upper threshold of <br />where the City will consider the builder and the developer teaming to use the developer's Letter <br />of Credit. Commercial properties will include a contract and Stage 1 Sureties. <br /> <br />Commissioner VanScoy requested information regarding the defInition of Final Stabilization <br />included in the ordinance. <br /> <br />Civil Engineer II Linton replied the builder or developer is required to have grass and pavement <br />in place.
