Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #25-235 <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR TACO BELL <br />AT 14751 ARMSTRONG BOULEVARD NW <br />WHEREAS, the City of Ramsey received an application from Border Foods (the <br />"Applicant"), requesting approval of a Conditional Use Permit, Site Plan Review, and Variance <br />on the property legally described as Lot 1, Block 1, Bunker Lake Crossing, Anoka County, <br />Minnesota (the "Subject Property")., and <br />WHEREAS, the Planning Commission reviewed the Conditional Use Permit and Site <br />Plan Review request at their regular meeting on May 27, 2025 and recommended approval; and <br />WHEREAS, the Planning Commission also reviewed the Variance request at that same <br />meeting and approved the request; and <br />WHEREAS, the City Council reviewed and approved the Conditional Use Permit and Site <br />Plan Review requests at their meeting on June 10, 2025; and <br />WHEREAS, the City Council reviewed and approved a Development Agreement at their <br />meeting on July 8, 2025; and <br />WHEREAS, the Landowner, Marvin Development VII, LLC, is requesting approval of an <br />Encroachment Agreement to allow for construction of a pylon sign encroaching within an existing <br />drainage and utility easement as described and shown within the agreement. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) The Mayor and City Administrator are hereby authorized and directed to execute said <br />Encroachment Agreement for and on behalf of the City of Ramsey, contingent on City <br />Attorney approval as to legal form. <br />The motion of the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />
