CC Regular Session <br />Meeting Date: 09/23/2025 <br />Primary Strategic Plan Initiative: Not Applicable <br />5. 4. <br />Title: <br />Adopt Resolution #25-173 Declaring the Property west of Xkimo Street and South of 15010 Xkimo Street as <br />Surplus and Authorizing Execution of a Quit Claim Deed to Dispose of Property <br />Purpose/Background: <br />In the fall of 2001, the City Council conducted a Public Hearing to consider vacating various road easement and <br />road right-of-way segments. In 2002, the City Council adopted Resolution #02-09, which vacated these road <br />easement and road right-of-way segments, as they were no longer needed due to adjacent development patterns. <br />While the vacation proceedings were completed and sent to Anoka County for recording, the City is still the fee <br />owner of one of these 'parcels', lying west of Xkimo Street and south of 15010 Xkimo Street (the "Subject <br />Property"). In reviewing this matter with the City Attorney, it was determined that the standard vacation process <br />was not truly going to terminate the city's interest/ownership in the Subject Property since it was originally <br />deeded to the city in fee simple. Thus, to properly dispose of this land that is no longer needed for public <br />purposes, the City will need to execute a Quit Claim Deed (QCD) to transfer the Subject Property to the owner of <br />the adjacent property at 15010 Xkimo Street (who has their septic system in this area, which the city granted a <br />permit for back in 1983). It should be noted that the Subject Property was deeded to Ramsey Township in 1971 to <br />accommodate a metes and bounds subdivision that created the block of residential parcels between Xkimo Street <br />and Waco Street, as well as the parcels on the west side of Xkimo Street. The residential parcels to the west and <br />south of the Subject Property were created through separate plats (Gorhams Sandy Acres Estates and Amber <br />Ridge, respectively). <br />Staff has been in contact with the property owners, Kaylee and Justin Allen. They have expressed interest in <br />obtaining the land. Staff suggests, as part of the transaction, the City pays for the filing of the Quit Claim Deed. <br />Notification: <br />Notification is not required. A public hearing was conducted when this vacation was originally contemplated. <br />Funding Source: <br />This case is being handled as part of Staffs regular duties. <br />Recommendation: <br />Staff recommends adopting Resolution #25-173 declaring the Subject Property as surplus and authorizing the <br />execution of a Quit Claim Deed to transfer ownership to the owner of the adjacent property at 15010 Xkimo St <br />NW. <br />Outcome/Action: <br />Motion to adopt Resolution #25-173 declaring the Subject Property as surplus and authorizing the execution of a <br />Quit Claim Deed to transfer ownership of the Subject Property to the owner of the adjacent property, generally <br />known as 15010 Xkimo Street. <br />Attachments <br />Site Location Map <br />
