10) Adopt Resolution #06-10-317 Supporting the Development and Construction of the
Multi-Use Mississippi River Regional Trail Corridor
11) Adopt Resolution #06-10-318 Declaring Excess Equipment

Motion carried. V oting Yes: Mayor Gamec, Councilmembers Jeffrey, Pearson, Cook, Elvig,
Olson, and Strommen. Voting No: None.

COUNCIL BUSINESS

Case #1:

Request for Extension to Submit Final Plat for Summerset Meadows
Subdivision; Case of Summerset Meadows LLC

Ass't Community Development Dir/HRA Executive Dir. Frolik stated on October 25,2005, the
City Council granted preliminary plat to Summerset Meadows, a residential subdivision located
south of Alpine Drive and west of Armstrong Blvd. Under City Code, a final plat must be
submitted no later than one year after preliminary plat approval. In order for the preliminary plat
to be valid after the one-year time limit, the City Council can grant a time extension to the
applicant. The developer of Summerset Meadows, LLC has submitted a request to the City
Council to extend the time limit to submit a final plat for their project to October 25, 2007. In
their letter, the developer has indicated the need to reevaluate the site plan given the considerable
decline in the marketability of multi-family units and the introduction of the Ramsey Crossing
commercial development on the eastern side of the Summerset Meadows subdivision. Ms.
Frolik advised staff recommends adoption of the resolution granting a one-year extension to
submit a final plat for the Summerset Meadows subdivision.

Mayor Gamec inquired if the right-of-way for the extension of CR 116 will be acquired through
this final plat.

Public Works Director Olson replied the City has purchased the northern 70 feet ofthe Adolfson
Peterson property for the future extension of Bunker Lake Boulevard. The Ramsey Crossings
project is an extremely fast paced project and it would definitely be necessary to acquire the
additional right-of-way in order to extend the road.

City Administrator Norman requested clarification whether the right-of-way would be up to the
proposed Mississippi River Corridor or all the way through to the property on the west.

Public Works Director Olson replied eventually the right-of-way would be needed all the way to
the proposed Mississippi River crossing. At this time there is not a great need for anything past
the first north/south crossing identified in the preliminary plat, which would align from the
Ramsey Crossings main entrance into the Ramsey Crossings site.

Mayor Gamec indicated it would be beneficial to obtain the right-of-way for the road extension.

City Attorney Goodrich advised the Council could request that the right-of-way dedication be
included as part of this continuation; however, it cannot be a contingency because there has
already been preliminary plat approval.

City Council / October 10, 2006
