Resolution Passed Opposing Use of County Funding for City Project — Add 1 <br />"We feel compelled to move forward with this resolution because we are adamantly <br />opposed to the legislation that diverted this funding how it was created and passed and we <br />strongly question its constitutionality," said Anoka County Commissioner Julie Jeppson, who <br />serves as the county's lead commissioner on transportation. <br />Commissioner Mike Gamache, chair, Anoka County Board of Commissioners, noted all <br />Anoka County commissioners were in favor of challenging the legislation. <br />"We support our County Attorney's Office to take any action needed to oppose this <br />diversion of funds," he said. "This shift ignores the Minnesota Department of Transportation's <br />own rules, policies and procedures, and reallocations of this nature need County Board approval <br />to take effect. We're hopeful that by opposing this legislation we can receive the entirety of our <br />regional transportation sales tax and use funding, so we can utilize it for projects that have more <br />benefit countywide." <br />Anoka County Attorney Brad Johnson noted his office had filed a complaint in Anoka <br />County District Court Sept. 23 seeking injunctive relief, which is a court order compelling a party <br />to perform or refrain from performing a specific action. <br />"Our marching orders are clear," he said. "The complaint speaks for itself, and we're <br />confident in our ability to defend the county's position." <br />-30- <br />DK:jr <br />
