Councilmember Riley introduced the following resolution and moved for its adoption: RESOLUTION #25-235 RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR TACO BELL AT 14751 ARMSTRONG BOULEVARD NW WHEREAS, the City of Ramsey received an application from Border Foods (the “Applicant”), requesting approval of a Conditional Use Permit, Site Plan Review, and Variance on the property legally described as Lot 1, Block 1, Bunker Lake Crossing, Anoka County, Minnesota (the “Subject Property”)., and WHEREAS, the Planning Commission reviewed the Conditional Use Permit and Site Plan Review request at their regular meeting on May 27, 2025 and recommended approval; and WHEREAS, the Planning Commission also reviewed the Variance request at that same meeting and approved the request; and WHEREAS, the City Council reviewed and approved the Conditional Use Permit and Site Plan Review requests at their meeting on June 10, 2025; and WHEREAS, the City Council reviewed and approved a Development Agreement at their meeting on July 8, 2025; and WHEREAS, the Landowner, Marvin Development VII, LLC, is requesting approval of an Encroachment Agreement to allow for construction of a pylon sign encroaching within an existing drainage and utility easement as described and shown within the agreement. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: The Mayor and City Administrator are hereby authorized and directed to execute said 1) Encroachment Agreement for and on behalf of the City of Ramsey, contingent on City Attorney approval as to legal form. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Stewart and upon vote being taken thereon, the following voted in favor thereof: Mayor Heineman Councilmember Riley Councilmember Peters Councilmember Buscher Councilmember Olson Councilmember Specht Councilmember Stewart
