This letter is intended as a reminder that state law requires a community to adopt its plan within nine <br />months from the date of Council action. Final action by the Ramsey city council is therefore needed by <br />December 28, 2001. <br />The Council is aware that the city has changed its charter to permit a simple majority of the city council to <br />adopt its plan. We are also aware that the city is contemplating a number of changes to the plan that was <br />reviewed by the Council. If the changes are made before the plan is officially adopted by the city council, <br />the Council may view the new plan as a substitute plan requiring full adjacent community review and full <br />comprehensive plan review. If the substitute plan is not submitted before December 28, 2001, the city would <br />appear to be in violation of the above cited state law. While the Council is willing to begin the full <br />comprehesive plan process again, there does seem to be a workable alternative. <br />The city council could adopt the plan as submitted to the Council with the changes recommended by the <br />Council on or before December 28, 2001. This would also satisfy the state law requirement for plan <br />approval. The changes to the plan could then be handled as simple plan amendments. Council procedures <br />for plan amendments allow staff to administratively handle amendments under 40 acres. Usually the Council <br />completes such reviews in 10 days or less. Amendments over 40 acres are taken to the Council for action, <br />but are also handled on a faster track that full comprehensive plan reviews. Normally, plan amendments are <br />handled as "consent" items and take less that 30 days to complete. <br />If the city council takes action on the full comprehensive plan update on or before December 28, 2001, <br />please send me a copy of the resolution for our files.
