~

~.(

Page 2 of2

with metropolitan system plans" as identified in the MDG. Minnesota Statute Chapter
473.859 Subd. 2 and Subd. 3 describe content requirements for water resource'
management, which includes ISTS. The December 1996 Water Resource Management
Chapter of the Metropolitan Development Guide establishes direction and action for
ISTS on pages 29 and 30. A key policy direction is number 7a, which says, "Support
state rules for on-site sewage disposal systems and work with local governments to assist
with their implementation". We can conclude that State Rules means Minnesota Rule
7080.

As a means to satisfy the Metropolitan Council requirements, the City of Ramsey may consider a
memorandum of agreement between the City and the Metro Council or a CC resolution that says
something to the affect that the City will look at or discuss establishing an ISTS management
program by December of 2000, or within the 2001 budgeting process.

I would also suggest that the City Attorney offer an opinion on the above two issues that remain
in question.

Please feel free to contact me at 612.338.0800 with any questions.
