CASE #

PUBLIC HEARING
REQUEST FOR COMPREHENSIVE PLAN AMENDMENT
FOR THE PROPOSED PLAT OF MARIGOLD POND;
CASE OF OAKWOOD LAND DEVELOPMENT
By: Amy Geisler, AICP, Associate Planner

Background:

Oakwood Land Development has submitted an application for an amendment to the 2001
Comprehensive Plan. The request is to change the land use designation from Rural Developing to
Low Density Residential on the property on the east side of Highway 47, north of the Boy Scout
Camp. The amendment to the Comprehensive Plan, along with a subdivision request, would
allow the applicant to develop the property with single-family homes served by sanitary sewer
and municipal water.

The following items are enclosed for your information:

a) Site Location Map
b) Preliminary Plat
c) Proposed Resolution approving the request and authorizing submittal to Metropolitan
Council

Notification:

State law requires that the City notify property owners within 350 feet of the subject property of
the request and public hearing date. Staff attempted to notify property owners within 700 feet of
the subj ect property.

Observations:

Oakwood Land Development is proposing to extend sanitary sewer and municipal water to the
subject property, located in the R-1 Residential- Rural Developing District. The preliminary plat
is proposing to develop the property with single family homes at urban densities. The 2001
Comprehensive Plan designates the subject property as Rural Developing. Development of
Marigold Pond with urban services requires a Comprehensive Plan Amendment to change the
subject property's land use designation from Rural Developing to Low Density Residential.

On April 26, 2005, the City Council adopted an Interim Policy for proposed land use changes
that are requested prior to the completion of the Comprehensive Plan update later this year. The
interim policy reads as follows, with Staff comments in italics:

1. The proposed land use considers traffic levels and patterns.
a. Traffic impacts of the proposal should be assessed for adjacent streets and affected
collector streets. Impacts resulting in a safety hazard, increase in fire or police response
time, or substantial increase in traffic congestion should be mitigated.
b. Potential future travel corridors should be identified and preserved where feasible.
