CASE # 4 <br />ADOPT ORDINANCE PARTIALLY VACATING A DRAINAGE AND UTILITY EASEMENT <br />• <br />AT 14438 IODINE STREET <br />By: Breanne Dalnes, Associate Planner and Steve Jankowski, City Engineer <br />Background: <br />Curtis Olson, a resident at 14438 Iodine Street within the Ponds of Ramsey subdivision, has requested <br />the vacation of a part of a drainage and utility easement on this property. The purpose of this easement <br />was to protected a wetland located on the property, however is has been determined that the wetland has <br />been reduced from its original size, probably due to a modification of the local hydrology. Mr. Olson <br />wishes to construct a patio and deck in the area of the vacated easement. A public hearing was held on <br />November 28, 2006 and the City Council introduced an ordinance partially vacating the easement. <br />Attached to the case are the following: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />C) Figure 1 illustrating deck and patio <br />d) Proposed ordinance <br />Staff has also made contact with the property owners on the property to the south of the subject property <br />As a result of the topographic information submitted by' the Olson's, it was discovered that a parcel <br />• approximately 42 square feet in area on this property lies slightly below the 100 year flood elevation. <br />The property owners are agreeable to having this deficiency corrected by having the area filled with <br />topsoil and restored with sod in the spring by city forces. <br />Recommendation: <br />Staff recommends the adoption of the ordinance partially vacating the drainage and utility easement <br />located on 14438 Iodine Street. <br />Council Action: <br />Motion to adopt Ordinance #06-_ to vacate a portion of the drainage and utility easements at 14438 <br />Iodine Street NW, as legally described and presented. <br />Review Checklist: <br />Asst.
