CC Regular Session <br />Meeting Date: <br />Primary Strategic Plan Initiative: <br />5. 11. <br />10/14/2025 <br />Create a positive image for residential neighborhoods, business districts and key <br />corridors. <br />Title: <br />Adopt Resolution #25-238 Approving an Extension of a Variance to Height for a Detached Accessory Building at <br />17646 St. Francis Boulevard NW (Project #24-121); Case of Chuck and Angie Lattery <br />Purpose/Background: <br />On October 24, 2024, the Planning Commission adopted Resolution #24-284 granting a variance to deviate from <br />the height restriction for a detached accessory building located in the side yard of the property known as 17646 St. <br />Francis Boulevard NW (the "Subject Property"). On September 30, 2025, the City received a written request <br />from Chuck and Angie Lattery (the "Applicant") seeking an extension to ensure they can obtain the building <br />permit needed before construction can begin. Mr. Lattery suffered a back injury in November 2024, which <br />severely limited his physical abilities until approximately March 2025. There was also a death in the family, <br />which further delayed the Applicant's ability to obtain the building permit. Thus, the Applicant is seeking this <br />extension to ensure that the variance does not become null and void, which will occur on October 25, 2025, if a <br />building permit for the detached garage is not issued. Should the City Council adopt Resolution #25-238, it will <br />supersede the original variance (Resolution #24-284) and will give the Applicant until October 14, 2026, to obtain <br />a building permit for the detached accessory building.
