<br />City Attorney Goodrich indicated the loan agreement will include an additional $16,000 to cover <br />the City's administrative expenses. There are almost $10,000 of appraisals that have occurred <br />that the Metropolitan Council will reimburse the City for. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Jeffrey, to authorize the City to <br />enter into a Loan Agreement between the Metropolitan Council and the City of Ramsey for <br />Protective Acquisition of Highway Right-of-Way for the Douglas and Julieann Hills' site located <br />at 7443/7445 Highway 10 NW in the City in an amount not to exceed $1,160,000, with an <br />additional $16,000 to cover the City's administrative expenses. (PIN 28-32-25-43-0002) <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Olson, Jeffrey, Cook, Elvig, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #4: <br /> <br />Adopt Ordinance Partially Vacating a Drainage and Utility Easement at <br />14438 Iodine Street <br /> <br />City Engineer Jankowski stated Curtis Olson, a resident at 14438 Iodine Street within the Ponds <br />of Ramsey subdivision, has requested the vacation of a part of a drainage and utility easement on <br />his property. The purpose of this easement was to protect a wetland located on the property; <br />however, it has been determined that the wetland has been reduced from its original size, <br />probably due to a modification of the local hydrology. Mr. Olson wishes to construct a patio and <br />deck in the area of the vacated easement. A public hearing was held on November 28,2006, and <br />the City Council introduced an ordinance partially vacating the easement. Mr. Jankowski <br />advised staff has also made contact with the property owners on the property to the south of the <br />subject property. As a result of the topographic information submitted by the Olson's, it was <br />discovered that a parcel approximately 42 square feet in area on this property lies slightly below <br />the 100 year flood elevation. The property owners are agreeable to having this deficiency <br />corrected by having the area filled with topsoil and restored with sod in the spring by City forces. <br />Mr. Jankowski advised staff recommends adoption of the ordinance partially vacating the <br />drainage and utility easement located on 14438 Iodine Street. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Pearson, to adopt Ordinance <br />#06-33 to vacate a portion of the drainage and utility easements at 14438 Iodine Street NW, as <br />legally described and presented. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Cook: aye <br />Councilmember Elvig: aye <br />Councilmember Jeffrey: aye <br />Councilmember Olson: aye <br />Councilmember Pearson: aye <br />Councilmember Strommen: aye <br /> <br />Motion carried. <br /> <br />City Council / December 12, 2006 <br />Page 11 of 29 <br />
