When there is any doubt as to whether a conflict exists, either pursuant to this policy or under <br />applicable law, the matter shall be resolved by the City Attorney. <br />All local officials, as defined in Minnesota law, must comply with Minnesota law regarding the <br />receipt of gifts. <br />PROCEDURE WHEN APPOINTED OFFICIALS HAVE A CONFLICT <br />When conflicts arise, the interested appointed official must: <br />1. Prepare a written statement or make a verbal announcement at the applicable public <br />meeting, describing the matter requiring action or decision and the nature of the potential <br />conflict of interest. <br />a) Deliver a copy of the notice to the chair of that board, commission or committee. If <br />the chair has the conflict, the notice should be delivered to the appointing authority, <br />the City Council. <br />PROCEDURE WHEN ELECTED OFFICIALS HAVE A CONFLICT <br />When conflicts arise, the interested elected official must: <br />1. Prepare a written statement or make a verbal announcement at the applicable public <br />meeting, describing the matter requiring action or decision and the nature of the potential <br />conflict of interest. <br />a) Deliver a copy of the notice to the presiding officer (typically the mayor). <br />b) If the mayor has the conflict, the notice should be delivered to the acting presiding <br />officer. <br />PROCEDURE WHEN STAFF HAVE A CONFLICT <br />1. Each staff member has a duty to disclose to the City Administrator, Finance Director <br />and/or Administrative Services Director the material facts of any proposed transaction of <br />the City in which such person has any conflict(s) identified by this policy. Staff shall <br />prepare a written statement describing the matter requiring action or decision and the <br />nature of the potential conflict of interest. <br />2. The disclosure required under item 1 (above) is to be made immediately and, to the extent <br />possible, before any consideration of such proposed transaction by the City. If a staff <br />member does not recognize the existence of a conflict prior to a decision regarding the <br />transaction, the staff member has a duty to disclose the material facts of the conflict as <br />soon as it is recognized. <br />3. A staff member having a conflict shall not participate in the deliberation or decision by <br />the City regarding the transaction under consideration unless invited by the City Council, <br />City Administrator, Finance Director, and/or Administrative Services Director, after <br />61 <br />
