Employees should always use proper safety procedures when using a cell phone, especially while <br />operating equipment, driving on City business, or performing similar duties. City employees <br />should only use a cell phone while operating a motor vehicle as permitted by Minnesota State <br />law. <br />All Department Heads and supervisors are responsible for enforcing this policy within their <br />departments and divisions. <br />Mobile Hot Spots/Tablets <br />Department Heads may provide mobile hotspots or tablets to staff as needed. They are <br />responsible for providing justification for the use of such devices, both initially and on an <br />ongoing basis. <br />Electronic Mail (E-mail)/SMS (Text) Messaging Systems <br />E-mail messages and text messages are subject to regulation under the Minnesota Data Practices <br />Act. The content of the message determines whether it is public or non-public/private. Both <br />methods are intended as communication mediums, not for permanent storage or maintenance of <br />official City records or other City information. <br />Inappropriate non -business use of the City e-mail systems and cell phones include, but is not <br />limited to: <br />• Transmission of non -business audio, graphic or movie files. <br />• Games, jokes, and chain emails. <br />• Content of an offensive, indecent, or pornographic nature. <br />• Copyrighted material. <br />• Large data files not directly related to City business. <br />Such items must not be sent or accepted as e-mail attachments, as they may change/decrease <br />performance or pose a security risk. Users should report any inappropriate or unsolicited e-mail <br />messages to the IT department by taking a screenshot or contacting IT by phone. <br />Users must practice the utmost respect while texting and may not use text messaging, e-mails, or <br />other City -provided communication systems to harass employees, citizens, or other individuals. <br />Such actions constitute harassment and are subject to investigation and disciplinary action under <br />the City's Anti -Harassment Policy. <br />The City reserves the right to use management software to block or eliminate junk e- mails <br />(SPAM), marketing emails, phishing emails, and emails containing profanity or other <br />inappropriate content without notice. <br />When utilizing City email, messaging systems, services, or devices, users must adhere to <br />applicable local, state, and federal laws, including the CAN-SPAM Act, to the best of their <br />ability. <br />Internet <br />79 <br />
