<br />4. That the Subject property is a riparian lot on the Mississippi River and is located in the <br />Critical River Overlay District. <br /> <br />5. That Ramsey City Code Section 9.11.02 does not permit the construction of accessory <br />buildings nearer the front property line than the principal building on lots less than two (2) <br />acres in size. <br /> <br />6. That Section 9.21.07 (Critical River Overlay District Development Standards) of City Code <br />establishes a structure setback of 100 feet from the Ordinary High Water (OHW) mark of <br />the Mississippi River or twenty (20) feet from the bluff line, whichever is greater. <br /> <br />7. That the principal structure on the Subject Property is located approximately 100 feet from <br />the front property line and seventy (70) feet from the OHW mark of the Mississippi River. <br />The principal structure is designated as lawful nonconforming. <br /> <br />8. That the Applicants are proposing to construct a 24' x 24' accessory structure on the <br />Subject Property that will be approximately forty-three (43) feet from the front property line <br />and about 110 feet from the OHW mark of the Mississippi River. <br /> <br />9. That the proposed accessory building will be approximately forty (40) feet from the nearest <br />side property line. <br /> <br />10. That the total square footage of accessory buildings on the Subject Property, including the <br />proposed building, will comply with the maximum allowable square footage in City Code. <br /> <br />11. That the proposed accessory building will comply with the height regulations outlined in <br />City Code. <br /> <br />12. That the accessory building will be designed with an exterior finish that matches the <br />principal building on the Subject Property. <br /> <br />13. That the proposed accessory building will not be visible from the river and will be fairly <br />well screened from adjacent properties by existing trees. <br /> <br />14. That the Subject Property is unique in that there is no public road frontage; the proposed <br />accessory building will be screened from view from Riverdale Dr by the home to the north <br />of the Subject Property and existing trees. <br /> <br />15. That if the accessory building were to be constructed in the rear yard, it would encroach on <br />the 100 foot setback from the Mississippi River. <br /> <br />16. That similar variances have been granted in the R-l MUSA District in the City of Ramsey. <br /> <br />17. That the Mississippi River setback requirement imposes a hardship on the Subject Property <br />that is not applicable to other lands in the same district. <br /> <br />RESOLUTION #06-09-272 <br />Page 2 of 4 <br />
