Voting No: None. <br />Case #2: Request for Conditional Use Permit for Bob Hamborg to Exceed Maximum <br />Amount of Accessory Building Space; Case of Bob Hamborg <br />Community Development Director Trudgeon indicated Bob Hamborg has submitted a blue print <br />for the construction of a 1,400 square foot accessory structure on the property at 15755 Traprock <br />Street NW. Construction of this size of structure on the property will cause an overage of <br />allowed garage and accessory structure space. The applicant has submitted a conditional use <br />permit application in order to construct the accessory structure at the size proposed. Mr. <br />Trudgeon explained the subject property is 4.33 acres. City Code allows a maximum total <br />square footage for accessory buildings of 2,900 square feet on a lot of this size. If the proposed <br />accessory structure is constructed at the size currently indicated on the blue prints, it would <br />create 3,760 square feet of accessory buildings. This equates to an overage of 860 square feet. <br />The subject property currently has one attached garage at approximately 1,160 square feet and an <br />existing accessory building at approximately 1,200 square feet. There are no driveways <br />proposed for either the existing accessory building or the proposed accessory building. The <br />applicant has expressed the need for additional indoor storage space in order to store the large <br />amount of items currently stored outdoors. <br />Mr. Trudgeon noted that the maximum accessory structure allotments were recently increased, <br />most significantly on .5 to 2.5 acre parcels. The allotment increase for lots ranging from 1.5 to <br />2.5 acres in size was 536 square feet. The reason that these parcel size categories were amended <br />is because they represent the range for which most applications for overages were received each <br />year. In the case of 4 acre parcels, there was an increase of 36 square feet made to the total <br />allotment, which was basically a rounding up. If the recent amendment to City Code had <br />followed through with a 500 square foot increase (in addition to the 36 square foot round up) to <br />all remaining parcel size categories exceeding 2.5 acres, then a 4-acre parcel would be allowed <br />3,400 square feet. On that basis, staff had recommended approval of a permit for an overage <br />limit of 500 square feet rather than the 860 square feet requested. It is noted that there is a fair <br />amount of tree screening on the nearest property line to the proposed building. <br />Mr. Trudgeon indicated the Planning Commission met on November 2 and held a public hearing. <br />There was one neighbor present whose accessory building encroaches onto Mr. Hamborg's <br />property. It was determined that the encroachment cannot be resolved with the requested <br />conditional use permit and requires separate action between the property owners. After <br />substantial discussion, the Planning Commission recommended approval for the full amount <br />requested, 860 square feet. The recommendation was based on the opinion that an 860 square <br />foot overage is not unreasonable on a four plus acre parcel. In addition, the Commission <br />supports indoor storage of personal equipment and vehicles. <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to adopt Resolution #06- <br />11-345 adopting Findings of Fact #0783 relating to request for a conditional use permit to <br />City Council /November 14, 2006 <br />Page 7 of 31 <br />-g- <br />
