CASE #
REQUEST TO REZONE PROPERTY FROM B-2 BUSINESS TO
PLANNED UNIT DEVELOPMENT (PUD);
CASE OF DPM INVESTMENTS, INC
By: Amy Geisler, AICP, Associate Planner
Background:
DPM Investments, Inc. has applied for a rezoning from B-2 Business to Planned Unit
Development (PUD) on the property located on the east side of Ebony Street just south of the
Super Bowl.
The following items are enclosed for your information:
a) Site location map
b) Zoning/land use exhibit
c) Findings of fact for denial
d) Findings of fact for approval
e) Proposed ordinance
*Meeting minutes are included with the Preliminary Plat case*
Notification:
Property owners within 700 feet were notified of the public hearing.
Observations:
The applicant is proposing to develop 6 twinhome units (3 two-unit buildings) on the subject
property. The property is located within the Mississippi River Overlay District, but over 800 feet
from the river itself. City Staff is in the process of updating the Overlay District requirements.
The draft code and the Comprehensive Plan require all new development in the river corridor to
be processed as a Planned Unit Development, in order to allow some flexibility in the design of
new development while protecting the river ecology.
The submitted preliminary plat and preliminary site plan were evaluated according to current R-2
Medium Density Residential standards for twinhomes. The plan meets all requirements with the
exception of lot width. The R-2 District requires a 50-foot lot width, and the plan shows five 40-
foot Lots and one 44-foot lot. The lot width deviation is permitted if the rezoning request to PUD
is approved.
As noted in the Comprehensive Plan Amendment case, the City Council last discussed Ebony
Woods at the November 14, 2006 regular meeting and directed the developer to prepare
additional revisions to the building elevations, which are discussed in the preliminary plat case.
-249-
