Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Elvig, Olson, <br />Pearson, and Strommen. Voting No: None. <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to approve Resolution <br />#06-11-346 to approve the conditional use permit request based on the findings of fact to exceed <br />allowable accessory structure space at 15755 Traprock Street NW. <br />Further discussion: Councilmember Jeffrey noted at the Planning Commission meeting there <br />was a discussion of the neighbor's building that encroaches on Mr. Hamborg's property. He <br />asked if it is Mr. Hamborg's desire to resolve the encroachment at some time in the future. Mr. <br />Hamborg replied yes, he has had a number of discussions with his neighbor about it and will <br />keep the City apprised to be sure the resolution is acceptable. Councilmember Elvig asked if <br />there is still an established association or covenants that are of any concern. Mr. Hamborg <br />replied the covenants mention accessory buildings. One requirement is that the building has to <br />be of similar or like appearance to the rest of the buildings on the property. Also, he is <br />responsible to bring it to his neighbors' attention that he would like to build something. He has <br />informed one of the neighbors in writing that he was planning on building this structure and <br />asked them to respond to him with any problems by this date; no one has responded. <br />Councilmember Jeffrey asked if the City requires documentation regarding this at the time of the <br />permit. Community Development Director Trudgeon replied this is between the private parties. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Elvig, Olson, <br />Pearson, and Strommen. Voting No: None. <br />Case #3: Request for Extension to Record Final Plat for Ramsey Town Center 6tn <br />Addition Subdivision; Case of D.R. Horton, Inc. <br />Community Development Director Trudgeon reviewed that on May 31, 2005, the City Council <br />granted final plat approval to Ramsey Town Center 6th Addition, a residential subdivision <br />located in Ramsey Town Center, north of East Ramsey Parkway and west of Peridot St. NW. <br />Under Chapter 9.50.02 (8) of City Code, a final plat must be recorded with Anoka County within <br />two years of approval unless the City Council extends the period at the applicant's request. Mr. <br />Trudgeon explained D.R. Horton, the developer of Ramsey Town Center 6tn Addition, has <br />requested an extension to record the plat. The final plat was approved on May 31, 2005; <br />therefore, the applicant would have until May 31, 2007 to record the plat. Under their request, <br />D.R. Horton would like to have until May 31, 2008 to record the plat. In conversations with <br />D.R. Horton, they have indicated their desire to complete the first phase of their development <br />(Ramsey Town Center 2°d Addition) as well as the residential market slowdown as the primary <br />reasons for their request. It should be noted that extending the date to record the plat does not <br />preclude D.R. Horton from filing the plat earlier than 2008 if market or other conditions change. <br />Councilmember Elvig stated he understands some of the finalized negotiations with D.R.
