<br />located in Riverdale Drive, but terminate at the Village Bank site. It will be the applicant's <br />responsibility to extend the lateral lines to both proposed lots in the right-of-way. All waste <br />removal and loading activities will take place at the side entrances of the building. Ms. Daines <br />stated a landscaping plan has been submitted, and is acceptable to staff. Additionally, a detailed <br />lighting plan has been submitted and is also acceptable. <br /> <br />Associate Planner DaInes advised staff recommends site plan approval contingent upon <br />compliance with City Staff Review Letter dated November 30, 2006, and approval of the <br />variance request to reduced parking and paving setbacks. <br /> <br />Citizen Input <br /> <br />Mr. Michael Cronin, representative of Holiday Stationstores, Inc., stated Holiday Stationstores <br />has been working with staff on this process. They believe staff has correctly explained this <br />exception area as creating the need for the variance, but also mitigating its effect with keeping <br />the green space in the area. Holiday Stationstores asks that the Board accept the recommendation <br />of staff and approve the variance request. <br /> <br />Board Member Brauer commented the City created the need for this variance with the additional <br />right-of-way. <br /> <br />Acting Chairperson Van Scoy stated he does not agree; the City created the right-of-way issue in <br />the corner so there was a partial impact, but the applicant is asking for a variance along the whole <br />area. <br /> <br />Mr. Cronin explained the exception area includes the greatest degree of variance. He stated <br />generally what happens is that most zoning ordinances assume a rectangular lot, and because of <br />the way Riverdale Drive curves and the truncated area there is one leg that is about 100 feet <br />shorter than the other leg. The greatest area of the variance is specifically driven due to the effect <br />from this curve, and he believes staff has taken that into account. He indicated the green space <br />will be there, so the intent of the ordinance will be met. He requested the Board to follow staff's <br />recommendation in granting the variance. <br /> <br />Acting Chairperson VanScoy asked how wide the greenspace will be. <br /> <br />Mr. Cronin replied in the exception area there will be a 20-foot band with the public area and the <br />Holiday area. He believes the intent of the ordinance is met. Mr. Cronin explained it would be <br />an incredible hardship to shift the whole store back. Due to the little amount of public impact, <br />the intent being met, and that there is hardship with the history of swapping land back and forth, <br />this is a solid application for a variance that will not set a precedent. <br /> <br />Board Member Brauer inquired about the plans for the existing Holiday station site. <br /> <br />Mr. Cronin replied Ramsey has been very kind to Holiday, but due to the safety improvements <br />that were made Holiday found this site that will allow them to do a better gas presentation, and <br />will allow them to serve the Ramsey community better.
