<br />Case # J <br /> <br />Public Hearing <br />REQUEST FOR VARIANCE TO FACILITATE THE CONSTRUCTION OF A <br />TELECOMMUNICATIONS TOWER ON CITY PROPERTY: <br />CASE OF T -MOBILE USA <br />By: Breanne Dalnes, Associate Planner <br /> <br />Background: <br /> <br />T-Mobile applied for a variance to the lot size, setback, and height restrictions for the <br />construction of a telecommunications tower on a residentially zoned parcel. The site <br />address is 15050 Armstrong Boulevard and is currently occupied by Fire Station No.1. <br />In residential districts, a tower must be setback 1.5 times the height of the tower from <br />property lines, must be a maximum of 120 feet in height, and must be located on a parcel <br />10 acres or more in size. <br /> <br />Since their application, Staffhas discovered that the appropriate zoning for the fire <br />station property, according to the 2002 Comprehensive Plan, is Public-Quasi Public. <br />Under this zoning district, there are no specific requirements for lot size, and the setbacks <br />follow the B-1 Business District, as deemed appropriate by the Zoning Administrator. <br /> <br />Additionally, it was determined that City Code allows City Council the discretion to <br />increase the maximum height standards by Council Action. Thus, a variance is also not <br />needed for the increase in height that the applicant is requesting. <br /> <br />Recommendation: <br /> <br />Open and close public hearing. <br /> <br />Board Action: <br /> <br />Note that the applicant and City agree that the request for all variances is considered <br />withdrawn because of zoning information provided. <br /> <br />Review Checklist: <br />Assistant Community Development Director <br /> <br />BOA: 1.4.07 <br /> <br />1 <br />
