<br />Assistant Community Development Director Frolik replied the City Attorney was not consulted. <br />The City is not required to include the general location or a map with the notice; the hearing <br />notice with the legal description of the property is required, and this information was correct. <br />The best attempt must be made to notify residents within 350 feet of the property; notification <br />was sent to residents within 700 feet of the property. <br /> <br />Acting Chairperson Van Scoy asked if there are any other requirements staff is aware of that <br />must be met to meet the legal notification requirements. <br /> <br />Assistant Community Development Frolik replied the place and time of the hearing and the legal <br />description are required to be included in the notice. <br /> <br />Mr. Overtoom stated with respect to the legal description of the property he is not sure that <br />"certain lots within the Brookfield Addition" qualifies as a legal description. <br /> <br />Assistant Community Development Director Frolik explained each numbered lot was not listed <br />in the notice, and some of the lots are in a subsequent phase. <br /> <br />Associate Planner Dalnes indicated there has not been a final platting of the lots and blocks yet. <br /> <br />Board Member Brauer inquired if there was a reason staff did not postpone this public hearing <br />until January when they were notified about the error in the notice. <br /> <br />Assistant Community Development Director Frolik replied staff felt the statute had been met and <br />decided to go forward with the public hearing, rather than to add more confusion and send out <br />another notice. <br /> <br />Mr. Overtoom stated during the initial preliminary plat hearings for Brookfield Addition Mr. <br />Peterson said this would be an upscale project with amenities with larger lots than necessary, and <br />that it would be a project everyone within the City could be proud of. He has done that to an <br />extent. However, to request a variance of front yard setbacks on this number of lots within this <br />development is pushing the envelope of what the City zoning and the preliminary plat of this <br />development has called for and has been agreed to. He does not believe that the City should <br />make mass variances on lot dimension setbacks for this project or any other project within the <br />City of Ramsey; it is not in the best interest of the community. <br /> <br />Mr. John Peterson, applicant, requested information from staff about what would be required to <br />re-notify this public hearing if it were to be rescheduled to January. <br /> <br />Assistant Community Development Director Frolik indicated the current public hearing would be <br />adjourned and a new public hearing would be advertised and a new mailing sent to the residents. <br /> <br />Mr. Peterson asked if the notice that was mailed included the incorrect information. <br /> <br />Assistant Community Development Director Frolik replied the same hearing notice was mailed <br />and included in the paper. <br /> <br />Board of AdjustmentlDecember 7, 2006 <br />Page 4 of 16 <br /> <br />P4 <br />
