<br />Board Member Levine introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-12-372 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0786 RELATING TO A <br />REQUEST FOR A VARIANCE FROM PARKING AND PAVING SETBACKS WITHIN <br />THE B-2 BUSINESS DISTRICT <br /> <br />WHEREAS, Holiday Stationstores, hereinafter referred to as "Applicant", has properly <br />applied to the Board of Adjustment for a variance to the parking and paving setback established <br />in Section 9.20.22 (B-2 Business District) of the Ramsey City Code on the property generally <br />located on the southeast comer of Ramsey Boulevard and US Trunk Highway 10, or legally <br />described as; <br /> <br />Lot 2, Block 4, Rivenwick Village <br /> <br />-or upon recording- <br /> <br />Lot 1, Block 1, Holiday Rivenwick Village <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on December 7, 2006 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That Section 9.20.22, B-2 Business District, establishes a parking and paving setback (green <br />space provision) of twenty feet from the right-of-way of public roads. <br /> <br />3. That the Holiday site plan indicates the intent to develop paving/maneuvering areas as close <br />as 5 feet from the right-of-way on the comer of Ramsey Boulevard and Riverdale Drive. <br /> <br />4. That additional right-of-way was given per the request of City Staff in the area where the <br />greatest deviation is requested. <br /> <br />5. That the special conditions causing the undue hardship, namely the dedication of additional <br />right-of-way on the comer of Ramsey Boulevard and Riverdale Drive, do not result from the <br />actions of the Applicant. <br />
