Board Member Levine introduced the following resolution and moved for its adoption: RESOLUTION #06-12-372 A RESOLUTION ADOPTING FINDINGS OF FACT #0786 RELATING TO A REQUEST FOR A VARIANCE FROM PARKING AND PAVING SETBACKS WITHIN THE B-2 BUSINESS DISTRICT WHEREAS, Holiday Stationstores, hereinafter referred to as "Applicant", has properly applied to the Board of Adjustment for a variance to the parking and paving setback established in Section 9.20.22 (B-2 Business District) of the Ramsey City Code on the property generally located on the southeast comer of Ramsey Boulevard and US Trunk Highway 10, or legally described as; Lot 2, Block 4, Rivenwick Village -or upon recording- Lot 1, Block 1, Holiday Rivenwick Village (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to Section 9.03.07 of the Ramsey City Code on December 7, 2006 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That Section 9.20.22, B-2 Business District, establishes a parking and paving setback (green space provision) of twenty feet from the right-of-way of public roads. 3. That the Holiday site plan indicates the intent to develop paving/maneuvering areas as close as 5 feet from the right-of-way on the comer of Ramsey Boulevard and Riverdale Drive. 4. That additional right-of-way was given per the request of City Staff in the area where the greatest deviation is requested. 5. That the special conditions causing the undue hardship, namely the dedication of additional right-of-way on the comer of Ramsey Boulevard and Riverdale Drive, do not result from the actions of the Applicant.
